Common use of Schedule of Services Clause in Contracts

Schedule of Services. Architect shall commence Services under this Agreement upon receipt of a notice to proceed and shall prosecute the Services diligently as described in Exhibit “A,” so as to proceed with and complete the Services in compliance with the schedule in Exhibit “C.” Time is of the essence and failure of Architect to perform Services on time as specified in this Agreement is a material breach of this Agreement. It shall not be a material breach if a delay is beyond the Architect’s or its Consultant(s)’ reasonable control.

Schedule of Services. Architect shall commence Services under this Agreement upon receipt of a notice written Notice to proceed Proceed and shall prosecute the Services diligently as described in Exhibit “A,” so as to proceed with and complete the Services in compliance with the schedule in Exhibit “C.” Time is of the essence and failure of Architect to perform Services on time as specified in this Agreement is a material breach of this Agreement. Subject to the industry Standard of Care, time is of the essence and failure of Criteria Architect to perform Services on time as specified in this Agreement is a material breach of this Agreement. It shall not be a material breach if a delay is beyond the Criteria Architect’s or its Criteria Architect’s Consultant(s)’ reasonable control.

Schedule of Services. 4.1 The Architect shall commence Services under this Agreement upon receipt of a notice Notice to proceed Proceed and shall prosecute the Services diligently as described in Exhibit “A,” so as to proceed with and complete the Services in compliance with the schedule in Exhibit “C.F.” Time is of the essence and failure of Architect to perform Services or of the District to perform its obligations on time as specified in this Agreement is a material breach of this Agreement. It shall not be a material breach if a delay is beyond the Architect’s or its Consultant(sconsultant(s)’ or District’s reasonable control.
