Common use of Return from Medical Leave Clause in Contracts

Return from Medical Leave. Upon return from medical leave, the Employee shall be reinstated to his/her former position, unless the leave exceeds (6) months. If the leave exceeds six (6) months, the position will be posted unless medical information regarding the individual indicates the mandatory posting should be reviewed. If the position is posted, the Employee, upon return, will be placed in a like position (i.e. hours, shift, pay scale) as the one they held prior to the leave. If a like position does not exist, the returning Employee will be placed in a position that is similar to the one they held. At a later date, should an opening occur in the same position, the returning individual will be given the first right of refusal. This preferential treatment shall be extended for a period of one year from the date the Employee returns.
