Common use of Return from Medical Leave Clause in Contracts

Return from Medical Leave. Employees returning from Medical Leave within one (1) year shall have the right to return to the same, or if that position has been eliminated, substantially equivalent position provided that they have been recommended or would have been recommended by their principal for reemployment. The employee shall notify the principal/immediate supervisor at least sixty (60) days in advance of the date he/she intends to return. An employee returning from Medical Leave more than one (1) year after leave commenced shall be assigned to the first available vacant position in the District for which he/she is qualified, provided that if more than one (1) employee has given notice pursuant to the paragraph, the employee who gave such notice at the earliest date shall be assigned to the position in question.
