Common use of Removal of Equipment Clause in Contracts

Removal of Equipment. In case of termination of this Agreement for any cause whatsoever, the Contractor, if notified to do so by the Owner, shall promptly remove any part or all of Contractor's equipment and supplies from the property of the Owner, failing which the Owner shall have the right to remove such equipment and supplies at the expense of the Contractor.

Removal of Equipment. In the case of termination of this Agreement for before completion from any cause whatsoever, the Contractor, if notified to do so by the Owner, shall will promptly remove any part or all of Contractor's its equipment and supplies from the property of the Owner. In addition, failing which after the Contractor has completed the Phase I Work and any Extra Work and the Engineer has accepted such work or issued a certificate of substantial completion, Contractor will promptly remove any part or all of its equipment and supplies from the property of the Owner. Should Contractor fail to do so, Owner shall have the right to remove such equipment and supplies at the expense of the Contractor.
