Common use of Qualifying Sick Leave Clause in Contracts

Qualifying Sick Leave. If an employee is sick for less than five days in a leave year, a portion of the accruing sick leave that is carried forward to the following year is to be recorded as qualifying sick leave. The portion recorded as qualifying sick leave is the difference between five days and the number of days (which must be less than 5) for which the employee was sick. Qualifying sick leave can accrue to a maximum of 20 (twenty) days out of the total accrued sick leave.
