PUT OR PAY. The parties agree that for the term, on a basis as herein set out, the Customer shall deliver to the facility for disposal of at least tons of waste, commonly known as a minimum waste volume.

PUT OR PAY. In the event this Agreement is a Put or Pay, then for any calendar month during the term Customer fails to deliver the minimum waste volume to this Facility, the shortfall shall be determined by subtracting the number of tons of waste actually delivered that calendar month by Customer to the Facility from the minimum waste volume Customer should have delivered for the calendar month. In such event, Customer shall pay Company an amount equal to the rate set forth above multiplied by the Put or Pay shortfall tonnage.

  • CONTRACT TIME AND LIQUIDATED DAMAGES (7-1-95) (Rev. 12-18-07) 108 SP1 G10 A The date of availability for this contract is September 26, 2016. The completion date for this contract is October 31, 2017. Except where otherwise provided by the contract, observation periods required by the contract will not be a part of the work to be completed by the completion date and/or intermediate contract times stated in the contract. The acceptable completion of the observation periods that extend beyond the final completion date shall be a part of the work covered by the performance and payment bonds. The liquidated damages for this contract are Two Thousand Dollars ($ 2,000.00) per calendar day.

  • Due date for payment The settlement date for each Tax Invoice issued by the Distributor must be the 20th day of the month in which the Tax Invoice is received, or if the 20th day of the month is not a Working Day, the first Working Day after the 20th day. However, if the Distributor fails to send a Tax Invoice to the Trader within 10 Working Days after the last day of the month to which the Tax Invoice relates, the due date for payment is extended by 1 Working Day for each Working Day that the Tax Invoice is late.
