Project Completion; Initiation of Operations Clause Samples

The 'Project Completion; Initiation of Operations' clause defines the criteria and procedures for determining when a project is considered finished and ready to begin normal operations. Typically, this clause outlines the specific milestones, inspections, or certifications required to confirm completion, and may detail the process for transitioning from construction or development to operational status. Its core function is to provide a clear and objective standard for project handover, reducing disputes about when obligations end and operational responsibilities begin.
Project Completion; Initiation of Operations. Upon Completion of Construction of the Project, the Recipient agrees to expeditiously initiate Project operations. The Recipient agrees to make all reasonable efforts to meet the Project Completion date established in Exhibit A. Such date shall be binding upon the Recipient unless modified in writing by the Division upon a showing of good cause by the Recipient. The Recipient shall deliver any request for extension of the Project Completion date no less than 90 days prior to the Project Completion date. The Division will not unreasonably deny such a timely request, but the Division will deny requests received after this time.
Project Completion; Initiation of Operations. Upon Completion of Construction of the MST Project, the District will expeditiously initiate MST Project operations. Except as provided in the SRF Loan Agreement, the District will not abandon, substantially discontinue use of, lease, or dispose of the Project or any significant part or portion thereof during the useful life of the MST Project without prior written approval of the Division. Such approval may be conditioned as determined to be appropriate by the Division, including a condition requiring repayment of all or any portion of all remaining funds covered by the SRF Loan Agreement together with accrued interest and any penalty assessments which may be due.
