Product Maintenance Exclusions. Tresys’ obligation, if any, to provide Product Maintenance hereunder is conditioned upon the proper use of the Software and does not cover Software that has been (i) modified, (ii) used contrary to Tresys’ instructions or (iii) serviced by anyone other than Tresys. Tresys’ obligations, if any, to provide Product Maintenance shall not be applicable to any Third-Party software or hardware, except as otherwise provided herein.
