Common use of Post Incident Testing Clause in Contracts

Post Incident Testing. Any employee for which carrying a firearm is a requirement of their position and who discharges their firearm in the course and scope of their duties shall be ordered to submit to alcohol and drug testing as outlined in this Article. Such testing shall not occur when the firearm discharge occurred in the course of training, testing or for legal recreational purposes. Where an employee has been ordered to undergo post-incident testing, he or she shall be placed on paid administrative leave pending receipt of the test result(s). If the test result(s) are negative, the member shall be returned to assigned duties pending the outcome(s) of any administrative and/or criminal investigation.
