Product Testing. Upon request, Customer shall provide Operator a laboratory report for each Product delivery by Customer or Customer’s supplier. Operator will not be obligated to receive Contaminated Product for throughput across the Berths, nor will Operator be obligated to accept Product that fails to meet the quality specifications set forth in the arrival notice.
Product Testing. Product shall be tested through reliable and valid means with documentation, consistent with the industry’s best practices.
Product Testing. Upon notification by ADOT to Wang of the completion of the initial assembly and testing of the Product by or under the direction of ADOT, any Acceptance Test shall be performed at a mutually designated location in the presence of representatives of Wang. If the Acceptance Test is successfully completed, Wang will complete the agreed upon payment schedule. If the Acceptance Test is not successfully completed, ADOT shall use its best efforts to make the necessary corrections to the Product within thirty days of receipt of Wang's notice of nonacceptance, at which time the Acceptance Tests shall again be conducted. The Acceptance Test may be repeated until it is successfully completed as provided herein.
Product Testing. Product samples will be sealed and transmitted to the Independent Lab or Purchaser to perform the ultimate and proximate analyses. These tests are the same as for the lignite testing with the added testing for product density and Iodine number. (What follows in Section 6 are typical quality control procedures and report formatting, which are not a part of this test protocol, but which should be included in the Independent Testing Company’s protocol.)

Product Testing. If UBEI knows, should know or reasonably suspects that any Raw Grains delivered by UBEI to the Plant do not meet the standards set forth in this Agreement, UBEI shall promptly so notify EKAE so that such Raw Grains can be tested before being unloaded at the Plant. If EKAE knows or reasonably suspects that any Raw Grains delivered by UBEI to the Plant do not meet the standards set forth in this Agreement, then EKAE may obtain independent laboratory tests of the affected Raw Grains. If such Raw Grains are tested and found to comply with all warranties made by UBEI herein, then EKAE shall pay all reasonable testing costs and if the Raw Grains are found not to comply with such warranties, UBEI shall pay all reasonable testing costs and EKAE shall be allowed to reject such delivery regardless of whether the affected Raw Grains have been unloaded.

Product Testing. If HR knows or reasonably suspects that any Distiller’s Grains produced at the Plant do not meet the warranty in Section 7.A or Section 7.B, HR shall promptly so notify UBE so that such Distiller’s Grains can be tested before loading the Distiller’s Grains at the Plant. If UBE knows or reasonably suspects that any Distiller’s Grains produced at the Plant do not meet the warranty in Section 7.A or Section 7.B, then UBE may obtain independent laboratory tests of the affected Distiller’s Grains. If such Distiller’s Grains are tested and found to comply with the warranty in Section 7.A and Section 7.B, then UBE shall pay all testing costs, and if the Distiller’s Grains are found not to comply with the warranty in Section 7.A and Section 7.B, HR shall pay all testing costs.

Product Testing. No later than [***] prior to a scheduled Delivery ARIAD US shall send to ARIAD SWISSCO the Delivery Documents for review. Following such review, unless within [***] of receipt of the Delivery Documents ARIAD SWISSCO gives written notice of rejection of the Product to be delivered, stating the reasons for such rejection, the Delivery shall proceed, and both Parties shall organize the same. Upon arrival at ARIAD SWISSCO nominated site it shall visually inspect the shipment of the Product to identify any damage to the external packaging. ARIAD SWISSCO may reject any shipment (or portion thereof) of the Product that is damaged by providing to ARIAD US reasonable evidence of damage within [***] after Delivery of such Product. If ARIAD SWISSCO does not so reject any shipment (or portion thereof) of the Product within [***] of Delivery of such Product, ARIAD SWISSCO shall be deemed to have accepted such shipment of the Product; provided, however, that in the case of the Product having any Latent Defect, ARIAD SWISSCO shall notify ARIAD US promptly once it becomes aware that a Product contains a Latent Defect and subsequently may reject such Product by giving written notice to ARIAD US of ARIAD SWISSCO’s rejection of such Product and shipping a representative sample of such Product or other evidence of Non-Conformance to ARIAD US within [***] after becoming aware of such Latent Defect, which notice shall include a description of the Latent Defect.
