Common use of Plans and Studies Clause in Contracts

Plans and Studies. The Operator shall oversee, coordinate and monitor the preparation and implementation of necessary studies, site planning, design studies, drawings, final plans and specifications for the construction of the East Bank Regional System prepared by its project engineer, architect and any other Consultants (collectively, the “Final Plans” and together with the Contracts and Subcontracts, the “Contract Documents”). The Operator shall make available for inspection by the District and its Representatives, copies of all plans, designs, drawings or other documents relating to the System or any part thereof, and the District shall have the right to independently review and offer comment on all such plans, designs, drawings or other documents prior to commencement of construction. All design documents, engineering documents, drawings and specifications prepared in connection with the System shall remain the property of the Operator during the Term. The District shall be entitled to receive copies of such documents upon the expiration of the Term.
