Common use of Pay on Movement to a New Position Clause in Contracts

Pay on Movement to a New Position. a) Assuming a Higher Paid Position When an employee assumes a position with a higher rate of pay, the employee’s rate of pay shall be adjusted to the minimum of the new range except that the rate will not be less than eight percent (8%) above current salary and not more than the maximum of the new range. If the addition of eight percent (8%) produces a rate between two (2) steps in the range of the higher paid position, the salary shall be adjusted to the higher of these two (2) rates. When an employee assumes a position with a higher rate of pay the new increment date shall be the date upon which the employee assumes the new position. Whenever an employee’s increment date or an adjustment in salary occur on the same date as a promotion or reclassification, the employee shall receive the increment or adjustment before the promotional formula is applied.

When Notwithstanding Article 20.7, when an employee assumes a position with a higher rate of pay the new increment date shall be the date upon which the employee assumes the new position.
