Ownership of Security. Save and except may have been disclosed by the Borrower to Bank in writing prior to the execution of this Agreement, the Concerned Borrower will, at the time of creation of the security as mentioned in Article 3 of this agreement, be the sole and absolute owner(s) of the premises and the Concerned Borrower will at the time of creation of such have a clear and marketable title to the premises free from all lien, lis-pendens, encumbrances, third party rights and impediments whatsoever.
