Owner Maintaining Eligibility to Receive Funding. The Contractor understands that the Owner must continuously meet all funding underwriting criteria established under the HUD Program. Should the Owner lose Program funding eligibility during the construction of the Project, the Owner will be responsible for direct payment to the Contractor for all unpaid invoices and/or incomplete work.

  • Funding Eligibility Contractor understands, acknowledges, and agrees that, pursuant to Chapter 2272 (eff. Sept. 1, 2021, Ch. 2273) of the Texas Government Code, except as exempted under that Chapter, HHSC cannot contract with an abortion provider or an affiliate of an abortion provider.
