Overtime and Callback. (a) Effective with the signing of this Collective Bargaining Agreement, off-duty Employees who are called to respond to an emergency situation shall be paid at the rate of time and One-half (1-1/2) for a minimum of Three (3) hours. In the event an Employee is required to work beyond Three (3) hours on one call, the rate of time and One-half (1-1/2) shall prevail for the remaining hours or any part thereof worked. On-duty Employees who are required to work beyond 0800 hours to fill out reports shall be paid at the rate of time and one-half of the Employee's regular wage rate. Said on-duty Employees shall complete a report for any such time immediately thereafter. (b) The call shall start from the time the Employee is contacted and responds affirmatively until the equipment is back in service, upon discretion of the officer in charge, provided, however, that with relief the Employee can be sent home and the call terminated. (c) Time and One-half (1-1/2) shall be paid for every hour worked in excess of the regular work schedule set forth in Article II of this Agreement. (d) When calling in additional Employees for Emergency Callback, the Township shall create and maintain an Emergency Callback list using the center of the Township (▇▇▇▇▇▇▇▇ and ▇▇▇▇▇▇▇▇▇), to determine the distance, by Internet map programs (i.e., Yahoo Maps, Mapquest, etc.), that each Employee lives from the center of the Township and the order in which they shall be called in by the person on "watch". It is further understood that the Township shall also create and maintain a second (2nd) list, that shall be used when the need arises for an extra dispatcher(s) to be hired for Emergency Callback position(s) in the "watch room." This distance, as determine which Employees live closest to Fire Headquarters and the order that they shall be called for this position. It shall be the responsibility of each Employee to notify the Fire Department Administration and the Union Executive Board when the Employee has an address change so that the Union Executive Board can determine the distance from the two locations as described in the above paragraphs. The new address shall also be forwarded to the Fire Department Administration to maintain the Emergency Callback and the Watchroom Emergency Callback lists. (e) Overtime shall be scheduled by the Shift Commander at Headquarters' station. Overtime shall be scheduled in accordance with the overtime policy as established by the membership of Local 1381. With respect to this section, an officer will be called in to work overtime and callback only when an officer is needed. In no case shall employees be compensated for less than two (2) hours when they are called in by the person on "watch"back to duty due to an emergency. It is further understood that the Township shall also create and maintain a second (2nd) list, that All employees called back for emergencies shall be used when compensated per Appendix A and B. To be eligible for the need arises minimum two hours of compensation, the employee must have left the workplace and been gone for at least 30 minutes. Overtime and Callback. (a) Effective 3.2.1 Overtime lists based on the total hours of opportunities offered shall be maintained by the captains for the rotational procurement of employees to fill vacancies and details when said employees are available. Where a tie exists, the opportunity shall go to the employee with the signing greatest seniority. A. Opportunities for overtime shall be offered equally to all employees. B. Every effort shall be made to fill vacancies with an employee of equal rank to the absent employee. If this is not possible, then an employee will be appointed to work out of grade. C. Each shift commander is responsible for daily updates of master personnel absentee records. D. The Chief will designate one Captain to be "Overtime Distribution Coordinator" and the other Shift Commanders will serve as backup. E. The Town shall not be responsible for any errors or omissions caused by Union personnel in carrying out the provisions of this Collective Bargaining Agreementsection. F. When filling vacancies for a twenty-four (24) hour shift, off-duty Employees who are called to respond to an emergency situation the overtime shall be paid at filled in ten (10) hour day shifts (08:00 to 18:00) and fourteen (14) hour night shifts (18:00 to 08:00). Employees shall not be scheduled to work more than forty-eight (48) consecutive hours. After 48 consecutive hours of work, there shall be a minimum 10- hour break before additional hours may be assigned or worked. This shall not include emergency coverage situations as determined by the rate Chief or his designee. G. If a detail is not filled by a member of time and One-half (1-1/2) for the bargaining unit after being offered to the bargaining unit, the Town may fill it with a qualified individual who is not a member of the bargaining unit. 3.2.2 An employee held overtime beyond their regular tour of duty shall be granted a minimum of Three two (32) hours overtime pay, and any overtime worked in excess of two (2) hours shall be compensated for the next full hour, and so on. An employee who is held beyond the end of an overtime shift that is less than ten (10) hours shall be compensated overtime pay to the next full hour, and any overtime worked in excess of the first hour shall be compensated for the next full hour, and so on. An employee who is held beyond an overtime shift that is ten (10) or more hours shall be granted a minimum of two (2) hours overtime pay, and any overtime worked in excess of two (2) hours shall be compensated for the next full hour, and so on. An employee called back to duty shall be compensated at an overtime rate of pay hereinafter set forth for at least four (4) hours, even if the overtime actually worked is less than four (4) hours. In Such an employee shall be released when the event an Employee situation initiating his overtime or call-back is required returned to work beyond Three normal. Any overtime worked in excess of four (34) hours on one shall be compensated for to the next full hour, and so on. The Chief or the Chief’s designee shall approve all scheduled non-shift overtime. An employee serving such duty shall be available for emergencies during the time period that they are being scheduled. If an employee has not yet completed their assignment at the point they are called for an emergency, no additional 4 hour minimum call, the -back period will be generated. 3.2.3 The hourly rate of time and One-half (1-1/2) shall prevail for the remaining hours or any part thereof worked. On-duty Employees who are required to work beyond 0800 hours to fill out reports overtime pay shall be paid at the rate of equal to time and one-half (1 and 1/2) the employee's hourly rate of pay. 3.2.4 The Town and the Union, hereby agree to those modifications which will provide compliance with the Fair Labor Standards Act (Revised) which became effective April 15, 1986. It is understood that the Union will be advised of any such changes prior to implementation and will be afforded an opportunity to discuss such changes. 3.2.5 An employee who is recalled to work from 12:00 midnight to 12:00 midnight on January 1, Thanksgiving, and December 25, shall receive double time for time worked as long as the holiday is not part of their regular Work Day. This section will not apply if an employee is recalled because of vacation or personal leave use. 3.2.6 If any employee is required, due to a job-related incident, to participate in any legal process (e.g. court appearance, deposition, etc.) during their off-duty hours, said employee shall be compensated at the overtime rate. If said employee is scheduled to work during the time of the Employeeappearance, the employee will be excused from work and coverage will be provided with no loss of pay or benefits to the employee. Mileage and out of pocket expenses will be reimbursed by the Town. 3.2.7 Employees will be compensated at the overtime rate for training which is required to maintain certification as an Emergency Medical Technician and is not done on duty. 3.2.8 Payment for extra paid details, Town or private, shall be at the employee's regular wage overtime rate, and shall be forthcoming in a timely manner no different than any other overtime. Employees shall receive a guaranteed minimum compensation of four (4) hours at the applicable detail rate on each occasion of private (non-Town) detail work. If the detail assignment entails work in excess of four (4) hours but less than eight (8), then employees shall be guaranteed eight (8) hours of compensation at the applicable detail rate. Said on-duty Employees shall complete a report for any such time immediately thereafter. Overtime and Callback. If an employee works seven straight days, it is the responsibility of the employee and/or their supervisor to properly code the double time on the employee’s time sheet. If the time is not coded correctly, the supervisor must submit a correction request to Payroll. Work which must be performed on Sunday shall be compensated at two (32) hourstimes the employee’s regular hourly rate. In the event an Employee is required to work beyond Three (3) hours on one callany given instance, the rate City will pay employees for overtime worked at the nearest 15-minute (quarter hour) increment of time. Thus, if an employee works 8 minutes or more, the employee will be paid for 15 minutes (rounding up); conversely, if an employee works less than 8 minutes, the employee will be paid for zero time (rounding down). Overtime and Callback. A. Forty (a40) Effective with the signing hour employees shall be paid overtime for all hours worked in excess of this Collective Bargaining Agreement, off-duty Employees who are called to respond to an emergency situation forty (40) hours in a seven (7) day work period or for all hours worked in excess of a regularly scheduled shift as established in Article 18. Twenty four (24) hour shift employees shall be paid overtime for all hours worked in excess of seventy two (72) hours in a nine (9) day work period or for all hours worked in excess of a regularly scheduled shift as established in Article 18. Overtime shall be paid at the rate of time one and Oneone-half (1 ½) times the regular hourly rate of pay as defined in Article 15 of this agreement. Overtime shall be calculated to the nearest quarter hour. The employee may elect to receive compensation for overtime worked by choosing one of the following: 1. Earned Leave – Overtime will be converted to vacation leave and posted to the employee’s vacation accrual bank at one and one-1/2half (1 ½) times the regular hourly amount for each hour worked. 2. Cash compensation – Employees shall receive cash compensation at the one and one- half (1 ½) times the regular hourly rate of pay for each hour worked. B. Forty hour employees shall have a minimum of Three eight hours off between their work shifts. C. Twenty four hour employees shall work no more than seventy two (372) hourshours consecutively without at least twenty four (24) hours off. An employee may voluntarily work ninety-six (96) consecutive hours but only if no other Union members are available to fill a vacancy. In the event of emergency staffing issues, an employee may be asked to stay over for no longer than six (6) hours following a seventy two (72) hour shift. In the event an Employee employee works longer than 48 hours, management must insure that proper rest is required given to work beyond Three the employee during structured hours to maintain an effective and safe response. D. Any call-back should be handled by the on duty Captain or acting Captain once it is known that there will be a need for a call-back. All call-backs will be handled according to the following durations: between 0-6hrs, between 6-12hrs, between 12-18hrs, and between 18-24 hrs. There will be a binder kept with callout lists for Captains and Firefighters with each time frame. Employees will be rotated to the end of the call-back list once they have accepted any amount of call-back in each of the above mentioned categories (i.e. – if someone accepts a 13 hr. call back, they are rotated to the bottom for the 12-18 hr. list but not the others). Employees will not be rotated due to any refusal. There will also be a “no-contact” log when unable to reach anyone by voicemail or message. 1. If the overtime shift is imminent, the call will move on to the next person without waiting for a response from a missed contact. Any time no contact is made, a refusal will be assumed. If the overtime shift is more than 24 hours away, then at least 30 minutes should be given to the employee to respond before moving on to the next person. If someone denies acceptance of the call back, then it is not necessary to wait. Any projected call backs for the month will be handled with the shift officer making calls using the engine cell phone each Saturday for only the week ahead with whatever shifts have not yet been filled. Shifts can be filled up to a week in advance if possible regardless of the day. Saturday is intended to fill those shifts that have not yet been filled for the week proceeding. 2. When calling any employee for a call-back in either of the above scenarios and no contact is made, an effort shall be made to leave a message with the employee indicating the date of the call-back, the amount of hours of the call-back, and the amount of time the employee has to respond. If the person making the call-back has moved past an employee due to no contact and that employee calls back while waiting on the next employee in line to accept the call-back, the first employee can still accept. The offer to the first employee remains active until the overtime opportunity has been filled. 3. Captains will have first option at overtime created by a Captain’s absence. Acting or temporary officers are not classified as Captains and are therefore not included when mentioning, “Captain.” If a Captain is not available for a Captain call-back, then individuals on the current promotional list will be called next for the Captain call-back. If nobody is available from the promotional list, then first class firefighters will be called next so long as there isn’t already a first class firefighter scheduled to work. There will be an effort made to try and ensure someone who has passed a promotional exam is available to supervise a shift before other options are considered. 4. Firefighters will have first option at overtime created by a firefighter’s absence. Acting or temporary officers are classified as firefighters and therefore shall be included when mentioning, “firefighter.” 5. Any individual on a K-day can accept a call back but only after both lists have been exhausted (ie – a FF call back with no FF’s accepting and then no Capt’s accepting). Nobody shall accept nor shall they be offered an opportunity at overtime if they are on vacation time or sick time. 6. Probationary firefighters are eligible for overtime providing that all other lists have been exhausted first including any individual who may be on a K-day. All efforts shall be made to prevent more than one probationary firefighter from working at the same time with a minimum staffing of three (3). Any exception to this rule must be authorized by the Fire Chief. Once probation has ended, these firefighters will be eligible for all call- back as mentioned above with the exception of officer call back. They will not be eligible for officer call back until a later date agreed upon by both labor and management. 7. Any individual offered call back overtime must accept the whole time being offered. If they cannot accept the whole time being offered then the person making the call back must continue through the list (ie – someone is offered a 24 hour call back but can only accept 22.5 hours of it due to a prior obligation, that individual will not be eligible for that call back and the offer must continue through the list). If all options have been exhausted and nobody is able to accept the full shift, then and only then, at that time can the call back be broken down in increments to fit people’s availability. 8. If there are multiple call-backs on the shift, the appropriate list will be used based on the most recent creation of call-back. 9. If there is a firefighter vacancy and no other firefighter is available to take the call-back, then the Captains will be called for an opportunity to take the call-back. If a Captain accepts a call-back created by a firefighter, then the Captain will assume responsibility for the shift as the company officer as long as there is not another Captain already working. If there is already another Captain working, the Captain whose shift is working will be the officer. If two Captains are working together on a shift that they are not assigned to, then the senior Captain will be responsible for the shift. A promoted Captain shall not work under or report to a firefighter. E. An employee called back for an emergency or unforeseen situation shall receive one and one- half (1 ½) times their regular straight time hourly rate of pay provided, however, the employee shall receive not less than two (2) hours on of pay at one call, the rate of time and One-half (1-1/2) shall prevail for the remaining hours or any part thereof worked. On-duty Employees who are required to work beyond 0800 hours to fill out reports shall be paid at the rate of time and one-half (1 ½) times the employee’s regular straight hourly rate of pay. However, when called back within two hours prior to their regular scheduled shift, the Employee's regular wage rate. (d) When calling in additional Employees for Emergency Callback, the Township shall create and maintain SECTION 2. If an Emergency Callback list using the center of the Township (▇▇▇▇▇▇▇▇ and ▇▇▇▇▇▇▇▇▇), to determine the distance, by Internet map programs (i.e., Yahoo Maps, Mapquest, etc.), that each Employee lives from the center of the Township and the order in which they shall be called in by the person on "watch". It is further understood that the Township shall also create and maintain a second (2nd) list, that shall be used when the need arises for an extra dispatcher(s) to be hired for Emergency Callback position(s) in the "watch room." This distance, as determine which Employees live closest to Fire Headquarters and the order that they shall be called for this position. It shall be the responsibility of each Employee to notify the Fire Department Administration and the Union Executive Board when the Employee employee has an address change so that the Union Executive Board can determine the distance from the two locations as described in the above paragraphs. The new address shall also be forwarded to the Fire Department Administration to maintain the Emergency Callback and the Watchroom Emergency Callback lists. (e) Overtime shall be scheduled by the Shift Commander at Headquarters' station. Overtime shall be scheduled in accordance with the overtime policy as established by the membership of Local 1381. With respect to this section, an officer will be called in agreed to work overtime and callback only when an officer is needed. However, if the Employer cancels the overtime list is exhausted with less than eight (8) hours notice the employee shall be paid a two (2) hour minimum at the overtime rate. SECTION 3. An employee performing the duties of a higher position shall receive out of class pay equal to five percent of the employee’s regular pay for all hours worked out of class. .
