Other Builders. The parties recognize and acknowledge that DEVELOPER may engage one or more independent builders to develop the Property, in which case DEVELOPER shall ensure that each builder receives a copy of this Agreement and agrees in writing to comply with this Agreement. DEVELOPER is, and shall remain, fully responsible to CITY for compliance with this Agreement with respect to all portions of the Property which DEVELOPER or its affiliates continue to own except to the extent other builders engaged by DEVELOPER enter into independent agreements with the CITY which exculpate DEVELOPER from liability arising from the activities of those builders. DEVELOPER shall have no continuing liability under this Agreement with respect to the actions of builders or others on portions of the Property that DEVELOPER no longer owns. DEVELOPER acknowledges that any transfer of ownership of any portion of the Property shall be in compliance with the requirements of the Development Agreement recorded in Official Records Book 7042, Page 1388, of the Public Records of Polk County, Florida.

Other Builders. The parties recognize and acknowledge that DEVELOPER may engage one or more independent builders other than DEVELOPER to effect the development of the Property, however, DEVELOPER shall ensure that each builder has received a copy of this Agreement and has agreed to comply with this Agreement. Nevertheless, DEVELOPER is, and shall remain, fully responsible to CITY for compliance with this Agreement by said additional builders unless said builders enter into independent agreements with CITY which exculpate DEVELOPER from liability due to those builders’ activities.

  • Builder’s Risk additional provisions The insurance specified shall be maintained in force until final acceptance of the project by the State.

  • Design-Builder The person or entity responsible for the proper completion of the activities described in the Contract Documents and who executes the Contract.

  • Capacity Building 1. Contractor will work in partnership with AOD to study the viability of billing under Drug Medi-Cal and 3rd party payer.

  • Construction Management Landlord or its Affiliate or agent shall supervise the Work, make disbursements required to be made to the contractor, and act as a liaison between the contractor and Tenant and coordinate the relationship between the Work, the Building and the Building’s Systems. In consideration for Landlord’s construction supervision services, Tenant shall pay to Landlord a construction supervision fee equal to three percent (3%) of Tenant’s Costs specified in Section 7.

  • Configuration Management The Contractor shall maintain a configuration management program, which shall provide for the administrative and functional systems necessary for configuration identification, control, status accounting and reporting, to ensure configuration identity with the UCEU and associated cables produced by the Contractor. The Contractor shall maintain a Contractor approved Configuration Management Plan that complies with ANSI/EIA-649 2011. Notwithstanding ANSI/EIA-649 2011, the Contractor’s configuration management program shall comply with the VLS Configuration Management Plans, TL130-AD-PLN-010-VLS, and shall comply with the following:

  • Work Loads If an employee believes the amount of work he or she is required to perform is excessive over what is required from the rest of the staff and it will result in an occupational accident or occupational injury to him or her, the question shall be referred to Section 17 of this Agreement.

  • Builder’s Risk Insurance Contractor shall provide a Builder’s Risk Policy to be made payable to the Owner and Contractor, as their interests may appear. The policy amount should be equal to 100% of the Contract Sum, written on a Builder’s Risk “All Risk”, or its equivalent. The policy shall be endorsed as follows: The following may occur without diminishing, changing, altering or otherwise affecting the coverage and protection afforded the insured under this policy:

  • Workload Management 11.1 The parties to this Agreement acknowledge that employees and management have a responsibility to maintain a balanced workload and recognise the adverse affects that excessive workloads may have on employee/s and the quality of resident/client care.

  • Work Load The professional obligation of academic employees comprises both scheduled and non-scheduled activities. The Guild and the District recognize that it is part of the professional responsibility of faculty to carry out their duties in an appropriate manner and place. As part of this responsibility faculty are expected to play an important role in the recruitment and retention of students, campus and departmental governance, program review, accreditation, planning and mentoring. Faculty commitment to retention will be demonstrated by informing students that they are to talk with the instructor prior to dropping the course. Faculty are encouraged to include a statement to this effect in their course syllabi. While it is understood that course syllabi content falls within the purview of the individual faculty member’s academic freedom, the parties also understand that items required to be part of syllabi in order to maintain college or continuing education accreditation must also be included. Tenured/tenure-track faculty who have less than a full-time contract are not eligible to work any additional assignments including long-term substitution (day-to-day substitution is allowed provided the limits specified in Section 5.2.1.3 are not exceeded). Faculty assignments shall be made in the following priority order: Tenured/tenure-track, pro- rata, overload, Priority of Assignment (POA) adjunct faculty assignments, then non-POA adjunct faculty.

  • Building Commissioning Services The Owner may provide as a part of its testing services the Building Commissioning services involving the project’s HVAC and exhaust systems, temperature control systems, fire detection and alarm systems, emergency power and lighting system, fire suppression system, security locks and security locking control systems, food service equipment (if applicable), and laundry equipment (if applicable). In the event the Using Agency’s Program specifies additional commissioning services, the Owner shall procure such services as well. The Owner, through its Executive Administrator, may engage an independent Commissioning Authority. It is the intent of this Article that the Commissioning Authority enforce the requirements mentioned herein and certify that the systems and equipment listed all function properly prior to the initiation of each final inspection.
