NO LIABILITY FOR INJURY OR DAMAGE. 9.04 The Member agrees that SeCan shall not be liable for any injury or damage (including death) or personal injury to the person of the Member or to any officer, employee, agent, shareholder or member of the Member, or for the loss of or damage to the property of the Member or its officers, employees, agents, sublicensees, shareholders or members in any manner based upon, occasioned by or in any way attributable to the SeCan Varieties, the Seeds of the SeCan Varieties or the exercise by SeCan of its rights, responsibilities and obligations under this Agreement.
