No Housing. Notwithstanding anything to the contrary, the parties agree and the Developer covenants that residential housing units (e.g., homes, apartments, or condominiums) will not be included as part of the Approved Plans, will not become part of the Project, nor be constructed or permitted on the Property. The Developer agrees this covenant will run with the land and bind future owners of the Property, and can only be removed as a restriction on the Property with the written consent of both the RDC and FDC. The Developer agrees to execute additional documentation as necessary, including a document in recordable form, to give effect to this restrictive covenant.
