No Additional Incentives. Seller agrees that during the Term of this Agreement it shall not seek additional compensation or other benefits pursuant to the Self-Generation Incentive Program, as defined in CPUC Decision 00-00-000, Buyer’s net energy metering tariff, or other similar California ratepayer subsidized program relating to energy production with respect to the Facility (other than grants from the Electric Program Investment Charge).
No Additional Incentives. Seller agrees that during the Term of this Agreement, Seller shall not seek additional compensation or other benefits pursuant to the Self-Generation Incentive Program, as defined in CPUC Decision (“D.”) 00-00-000, the California Solar Initiative, as defined in CPUC D.00-00-000, PG&E’s net energy metering tariff, or other similar California ratepayer subsidized program relating to energy production with respect to the Facility.
No Additional Incentives. Seller agrees that during the Term of this Agreement, Seller shall not seek additional compensation or other benefits with respect to the Facility pursuant to the Self-Generation Incentive Program as defined in CPUC Decision 00-00-000, the California Solar Initiative as defined in CPUC Decision 00-00-000, PG&E’s net energy metering tariff, or programs that succeed or replace these programs, unless such program(s) are for a future product related explicitly to energy storage on the utility side of the meter. Seller may participate in other California ratepayer subsidized programs relating to energy production with respect to the Facility so long as such participation does not adversely affect Seller’s delivery of Product or performance of its obligations under this Agreement. GREEN ATTRIBUTES; RESOURCE ADEQUACY BENEFITS Conveyance of Green Attributes. Seller hereby provides and conveys all Green Attributes associated with all electricity generation from the Project to Buyer as part of the Product being delivered. Seller represents and warrants that Seller holds the rights to all Green Attributes from the Project, and Seller agrees to convey and hereby conveys all such Green Attributes to Buyer as included in the delivery of the Product from the Project.
No Additional Incentives. Seller agrees that during the Term of this Agreement, Seller shaU not seek additional compensation or other benefits pursuant to the Self4 Generation Incentive Program, as defined in CPUC Decision ("D.") 00-00-000, the California Solar Initiative, as defined in CPUC 0.06-01-024, PG&E's net metering tariff, or other similar California ratepayer subsidized program relating to energy production with respect to the Facility.
No Additional Incentives. Seller agrees that, during the Term of this Agreement, Seller shall not seek additional compensation or other benefits pursuant to (state incentive programs and ratepayer subsidized programs relating to energy production) with respect to the Facility at issue in this Agreement.
No Additional Incentives. Other than the amounts described in subparagraphs (b) and (c) of this Section 5, the Executive shall not be eligible to receive any other equity grants or annual incentive awards during the term of this Agreement.
No Additional Incentives. SELLER warrants that it has not received any other incentives and it further agrees that during the Term of this Agreement, SELLER shall not seek additional compensation or other benefits from SMUD pursuant to the SMUD’s net metering tariff, the California Solar Initiative, or other similar California ratepayer subsidized program relating to energy production with respect to the Facility.
No Additional Incentives. The Seller warrants that it has not received any other incentives funded by the Buyer’s ratepayers and it further agrees that, during the Term, it shall not seek additional compensation or other benefits from the Buyer pursuant to the following programs of the Buyer:
No Additional Incentives. SELLER warrants that it has not received nor shall SELLER apply for or seek any other incentives from GLENDALE for the Facility, and SELLER further agrees that during the Term of this Agreement, SELLER shall not seek additional compensation or other benefits from GLENDALE pursuant to GLENDALE’s Net Metering Agreement, the California Solar Initiative, or other similar California ratepayer subsidized program relating to energy production with respect to the Facility.
