Negligence or Wrongful Conduct of the Airline. Notwithstanding the provisions of this Section 4.05, in the event that due to the negligence or willful act or omission of Airline, its employees, its agents, or licensees, Premises shall be damaged or destroyed by fire, other casualty or otherwise, there shall be no abatement of rent or obligation to provide alternate facilities during the repair or replacement of said Premises. To the extent that the costs of repairs shall exceed the amount of any insurance proceeds payable to City by reason of damage or destruction due to the negligence or willful act or omission of Airline, its employees, its agents, or licensees, Airline shall pay the amount of such additional costs to City.
