Minimum Allocation for Top-Heavy Plans. The contribution and allocation provisions of this Section 3.01(E) apply in any Plan Year in which this Plan is a Top-Heavy Plan. 1. Except as otherwise provided in (2) below, the Employer Contributions and Forfeitures allocated on behalf of any Participant who is not a Key Employee shall not be less than the lesser of (a) 3% of such Participant's Compensation or (b) the largest percentage of Employer Contributions and Forfeitures, as a percentage of Key Employee's Compensation, as limited by Section 401(a)(17) of the Code, allocated on behalf of any Key Employee for that year. Subsection (b) shall not apply if the Employer has a defined benefit plan which it uses to satisfy the requirements of Section 401(a)(4) or 410 of the Code. The minimum allocation is determined without regard to any Social Security contribution. The minimum allocation shall be made even though, under other Plan provisions, the Participant would not otherwise be entitled to receive an allocation, or would have received a lesser allocation for the year because of (a) the Participant's failure to complete 1,000 Hours of Service (or any equivalent provided in the Plan), or (b) the Participant's failure to make mandatory Employee contributions to the Plan, or (c) the Participant's Compensation is less than a stated amount.

  • Full Employer Contribution - Basic Eligibility Employees covered by this Agreement who are scheduled to work at least seventy-five (75) percent of the time are eligible for the full Employer Contribution. This means:

  • Partial Employer Contribution - Basic Eligibility The following employees covered by this Agreement receive the full Employer Contribution for basic life coverage, and at the employee's option, a partial Employer Contribution for health and dental coverages if they are scheduled to work at least fifty (50) percent but less than seventy-five (75) percent of the time. Any earnings on the withdrawn excess contribution may also be subject to the 10% early distribution penalty tax if you are under age 59½. Excess contributions for one year may be carried forward and applied against the contribution limitation in succeeding years.   • Special Maternity Allowance for Totally Disabled Employees (a) An employee who:

  • Elective Deferrals An Employee will be eligible to become a Contributing Participant in the Plan (and thus be eligible to make Elective Deferrals) and receive Matching Contributions (including Qualified Matching Contributions, if applicable) after completing 1 (enter 0, 1 or any fraction less than 1) Years of Eligibility Service.
