MCPAA Reopener. At the option of the MCPAA, between March 1, 2011, and April 15, 2011, the MCPAA may exercise an option to reopen Article 7. This MCPAA reopener option will be to evaluate the market for all levels of the MCPAA DDA pay scale and to bargain for a new DDA pay scale for any or all levels of the MCPAA DDA pay scale, to be effective July 1, 2011. If the MCPAA exercises this reopener option, before a new pay scale for any or all MCPAA DDA levels is agreed upon, the parties will conduct a market evaluation, with agreed upon comparators. If the parties agree that any of the MCPAA DDA levels are being paid, at or below ninety-eight percent (98%) of the prevailing market, then it will be the option of the MCPAA to have the MCPAA salary matrix for July 1, 2011, adjusted upwards, by a maximum increase of five percent (5%), to reflect the increase necessary so that the MCPAA salary matrix will be in line with the market evaluation. Should the MCPAA exercise this option the salary matrix adjustment set forth in Addendum A for July 1, 2012, will be adjusted by the parties to ensure that only a total of a five percent (5%) market adjustment will occur to any MCPAA DDA level during FY 11-12 and FY 12-13.

  • Wage Reopener The parties agree they may re-open negotiations on compensation adjustments dependent upon economic feasibility. Indicators of economic feasibility will be: the Director determines implementation of such adjustments is economically feasible and the legislature appropriates funding in accordance with applicable law; if a State initiative or referendum is submitted to the voters and is passed that specifically provides funding for general salary increases for higher education employees; or the University provides across the board salary increases to Civil Service and/or Administrative Professional employees. If tentative agreement is achieved, the University will submit a request to OFM for a finding of financial feasibility and, if such a finding is made, for approval and funding by the Governor and Legislature when necessary.

When EZ Phone or its authorized agent owns the splitter, Line Splitting requires the following: a non-designed analog Loop from the serving wire center to the NID at the End User’s location; a collocation cross connection connecting the Loop to the collocation space; a second collocation cross connection from the collocation space connected to a voice port; the high frequency spectrum line activation, and a splitter. The Loop and port cannot be a Loop and port combination (i.e. UNE-P), but must be individual stand-alone Network Elements. When BellSouth owns the splitter, Line Splitting requires the following: a non designed analog Loop from the serving wire center to the NID at the End User’s location with CFA and splitter port assignments, and a collocation cross connection from the collocation space connected to a voice port.

  • Time Off in Lieu of Overtime Employees who work overtime will not be required to take time off in regular hours to make up for overtime worked. Time off in lieu may be taken on a mutually agreed upon basis between the employee and the Hospital, such time off will be the equivalent of the premium rate the employee has earned for working overtime. The Hospital shall revert to payment of premium rate if time off is not taken within ninety (90) calendar days of the work week in which the overtime was earned or, with the employee’s agreement, within 12 months of that work week.

  • Building Commissioning Services The Owner may provide as a part of its testing services the Building Commissioning services involving the project’s HVAC and exhaust systems, temperature control systems, fire detection and alarm systems, emergency power and lighting system, fire suppression system, security locks and security locking control systems, food service equipment (if applicable), and laundry equipment (if applicable). In the event the Using Agency’s Program specifies additional commissioning services, the Owner shall procure such services as well. The Owner, through its Executive Administrator, may engage an independent Commissioning Authority. It is the intent of this Article that the Commissioning Authority enforce the requirements mentioned herein and certify that the systems and equipment listed all function properly prior to the initiation of each final inspection.
