Mandatory Deductions. 1. In the event an employee fails to pay the dues, fees, or assessments established by the Association (as authorized by this Agreement) either directly to the Association or through payroll deduction, the employer shall, at the request of the Association, deduct the service fee from the employee's wages and remit same to the Association. 2. The Association shall indemnify the Board against any and all claims, demands, suits, or other forms of liability of whatsoever kind and nature that shall arise out of action taken by the Board for the purposes of complying with the provision of this agreement, provided that the Board sought and received the agreement of the Association prior to such action, or acted at the request of the Association. The Association and the District shall mutually agree on the selection of the legal counsel to be used in the event this provision is invoked.
