Licensee Property. Licensee retains exclusive ownership of all rights, title and interest in and to all material provided to Flexera by or on behalf of Licensee.

Licensee Property. LICENSEE shall assume all responsibility for any equipment or goods placed in or on the City of West Plains’ property. LICENSEE further indemnifies and holds harmless the City of West Plains and the Old Time Music / Ozark Heritage Festival from any claims from anyone for loss or damage to property placed on the premises of the City of West Plains.

As between Licensee and Veritone, Licensee retains all right, title and interest (including Intellectual Property Rights) in and to Licensee’s Content, and any software, technology, trademarks, brand identifiers, materials and information which are independently created, authored, developed, conceived or reduced to practice by Licensee.

The Licensee Property shall consist of (i) the website available at the following URL: xxx.xxxxxxxx.xxx (the “Website”), and (ii) the mobile application known as CUR Music (the “Application”), each of which (a) may be made available on any hardware device and (b) allows end users to legally stream music and purchase individual music tracks as part of Licensee’s music service. The Licensee Property shall be at all times exclusively (1) owned, controlled and operated by Licensee and (2) Licensee branded (i.e. not co-branded or white-labeled).

All watchmen or other protective service (other than security provided in Section 9) must be arranged for by special agreement with Parks Department or independently by Licensee.
