LEAVES ADDRESSED BY LAW AND ACGME REGULATIONS. KSOM shall comply with, by continuing to provide Residents/Fellows access to, any and all employment leaves of absence required by local, State or Federal law, including but not limited to applicable leaves of absence for bereavement, family and medical (e.g., pursuant to the Family and Medical Leave Act of 1993 (“FMLA”) and the California Family Rights Act (“CFRA”)), jury duty, military and pregnancy leaves. Additionally, KSOM shall comply with any and all applicable ACGME requirements regarding leaves of absence, including requirements regarding approved medical, parental and caregiver leave(s) of absence. Residents/Fellows requiring any leave of absence shall contact KSOM Human Resources to request such leave or obtain information on the availability of such leaves. No Resident/Fellow shall face intimidation, coercion or retaliation for exercising their right to request or take a leave under this Article.
