JOB. All Nothing in this Article shall preclude any employee AT ANY TIME from submitting their application together with details of their qualification for any occupation existing or which may come into existence within the Company. An employee shall not make application for jobs which do not constitute a promotion or upgrading for them. It is understood, however, that where a lateral transfer or demotion may open up an avenue of future promotion that would otherwise be closed, an employee may make application. Exceptions to this general rule will also be permitted for genuine compassionate grounds. (a) Eliminated the job from which the employee was granted leave; or Has caused a situation whereby the employee returning from leave no longer has sufficient seniority to occupy a job in the same classification, the employee will be permitted to exercise their seniority as per Article Workforce Reductions and Recall.
(a) Salary actions that fall due during approved leaves of absence up to three (3) months will be effective from the first day back to work. For approved leaves of absence which last more than three months, a credit of three months service for the purpose of wage grid progression shall apply. An employee who shall be found and certified by a qualified physician to be unable to perform their regularly assigned duties with the Company assesses that he could reasonably qualify during that period and that he could perform the required work safely. Jobs shall not be considered vacant when employees are not at work because of sickness, accident, sickness or authorized injury shall receive a leave of absence. HoweverIf the employee is able to perform other duties with the Company and such work is available, the employee will be placed in such job classification. However, it is understood that a jury or witness fee, exclusive of expenses paid to them will be turned over to the Company as an offset against their salary. The employee will report back for work when the employee is released from jury or witness duty at any time prior to noon. Employees who become pregnant must report their pregnancy to the Occupational Health Nurse within four (4) months after conception. An employee with at least thirteen (13) weeks continuous service, who becomes pregnant, will on request be granted unpaid leave of absence of up to seventeen (17) weeks. A further thirty-five (4535) working days, the job weeks unpaid parental leave shall be posted granted immediately after the end of the pregnancy leave, if so requested. During such leave, seniority, service, vacation and sick leave credits will accumulate. The employee shall make arrangements with the Human Resources Department for the continuation of insured benefits in accordance with Article including the method of payment. JOB. All In the event that additional vacancies occur by the filling of a job posting, the effective date of promotion will not occur until such time as all vacancies in created by an initial posting have been filled unless otherwise required to ensure the efficient operation of the Association. JOB. All job vacancies in new or existing jobs within any department The Assured Number of Jobs i-n the East shall be posted two hundred and will not be reduced during the term of this Agreement, except in the event of a store closure or a major disaster. All these full-time employees will be offered Assurance of Employment of thirty-seven hours per week in accordance with Article of Agreement, in the bargaining units set forth in Article 2 of this Agreement, during the period from May and for the term of this Agreement and until the time set forth in Section of the Labour Relations Act has elapsed, except in the event of the closure of, or a major involving their store. Any employees who are off on the bulletin disability leave for or Workers Compensation for a period exceeding two years or who are employed for the purpose of ten replacing employees who are absent to sickness and accident will not be in the count for the assured jobs. In the event of a store closure or a major disaster, the Assured Number of Jobs is reduced by lay-off by the number of employees in the affected store. In the event of a new store opening, the Assured Number of Jobs would only increase by the number of “true new hires”. In the event the Assured Number of Jobs falls below the required Number and the Employer would encounter difficulties replacing employees who leave, the Employer and the Union may mutually agree that the Employer will not be required to replace such and such agreement Will not be unreasonably withheld. An employee relieving in position of Assistant Store Manager, Grocery Manager, Produce Manager, Junior Produce Manager, Customer Service Manager, Meat Manager, Assistant Meat Manager, Bakery Manager, Assistant Bakery Manager, Service Department or Night Shift Lead Hand, shall receive the hourly rate for the classification to which they are temporarily assigned, they have completed more than one working day in such cation, exclusive of Sundays and Statutory Holidays, in a seven calendar days prior week. JOB. All a) When a new job vacancies classification in new the bargaining unit is add- ed or existing jobs additional employees are required or a vacancy arises in any of the job classifications within any department shall be posted on the bulletin bargaining unit, the Company will post a notice of a vacancy for a period of ten calendar three (3) consecutive days prior on a bulletin board. The notice will specify the classification, the wage scale and the qualifications required for the position. An employee who wishes to be considered for the filling position so posted must do so within the three (3) days period by signing the posting and using the form supplied by the Company. All shall show the position, the route number, the nor- mal hours of work and days off, and expected duration of the job position (if applicable). Effective April on by the Unemployment Insurance Commission of the appropriateness of the Hospital's Supplemental Unemployment Benefit (SUB) Plan, an employee who is on pregnancy leave as provided under this Agreement who is in receipt of Unemployment Insurance pregnancy benefits pursuant to Section of the Unemployment Insurance Act, be paid a supplemental unemployment benefit. That benefit will be equivalent to the difference between seventy-five per cent (75%) of her regular weekly earnings and the sum of her weekly Unemployment Insurance benefits and any other earnings. Such payment shall return commence following completion of the two week Insurance waiting period, and receipt by the Hospital of the employee's Unemployment Insurance cheque stub as proof that she is in receipt of Unemployment Insurance pregnancy benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of (1 5) weeks. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to his former job.the commencement of the leave times her weekly hours. The employee does not have any vested right except to receive payments for the covered unemployment period. JOB. All job vacancies in The Police Board shall have the right to hire civilian employees for a probationary period of not more than six (6) months. The said Board shall have the right to dismiss such probationary employees, without cause, at any time during the probationary period, and such dismissal shall not be the subject of a grievance. JOB. When a vacancy occurs in any job which is likely to remain open for over four work weeks (or such longer period as the parties may mutually agree) notice of such vacancy shall be posted within eighteen working days of the vacancy arising and shall remain posted for five working days on the bulletin board or boards provided on the premises for that purpose. The Company shall provide the Union with a copy of each vacancy posted. JOB. All (a) A job vacancies in new or existing jobs within any department posting for a permanent position shall contain the classification of the position as as the range, and such other as may be appropriate. It is understood that no employee is allowed to give up their rights to any job bid more than times per calendar year. As an exception, where a bid is accepted within the classification, but involves a shift change, the employee can only elect to give up their bid providing it is within the first five (5) days. Once four (4) employees have been given opportunities to qualify for any one vacancy, the job will be re-posted. The rate of pay effective for an employee transferring under this section will be at the thirty-first (31) day same step of progression for the new classification as he is being paid for the classification he is transferring from. The Union will be given copies of all bids and applicants and bid awards. The company agrees to post any positions that new hires are placed in, so seniority employees can apply. These jobs will be posted one week after hire. If the Company elects to create a new classification it will inform the bargainingcommittee in writing setting forth the classificationand the rate of pay. The union shall have five working days to dispute the rate of pay assigned to the classification. If at the expiration of the five working days no formal dispute has been filed, the rate established shall be permanent. When such temporary assignments are made, the employee involved will be paid the rate of pay for his own position or the position to which he is being temporarily assigned, whichever is higher, for the length of the temporary assignment. The Company agrees to annually canvass employees to determine which employees are interested in temporary assignments, and when possible, make temporary assignment opportunities available to them. In case of temporary assignments of more than one week, the assignment will first be offered to the senior qualified employees in the classification from which the transfer is being made. JOB. All When a vacancy occurs or a new position is created, the Employer shall ensure that the notice of the position is posted at each work location and on a Conference on the Employer's internal email system for a minimum of five (5) working days in order that all employees will know about the position and be able to make written application. JOB. All In the event that a permanent vacancy comes open in a position other than entry level jobs which are listed in Group & in Schedule Appendix notice of such vacancy shall be posted for five (5)working days on the bulletin boards identified in Article Such notices shall indicate the job title, nature of the job duties, specific skills, knowledge or education required for the job, classification, rate of pay and shift. Employees wishing to apply for such vacancy must do so during the posting period by submitting an application on a Company supplied form to the Human Resources Department. Employeeswill be provided with a copy of their application form which will be initialed as received by a Human Resources representative. The provisions of Article B shall determine which employee shall be awarded the vacancy. Nothing contained herein precludes the Company from recruiting for the position if there are no successful internal applicants. When it is necessary for the Employer to temporarily transfer an Employee to another classification, the Employee shall apply. JOB. All job Where a permanent vacancy occurs in a classification within the bargaining unit or a new position within the bargaining unit is established by the Hospital, such vacancy shall be posted for a period of seven (7) consecutive calendar days. Applications for such vacancy shall be made in writing within the seven (7) day period referred to herein. A These descriptions shall become the accepted job descriptions unless the Union presents written objection, within a calendar month of receipt of the description wherein it may request that it may be discussed at a meeting between the Board and the Union. JOB. The vacant job shall be posted on the bulletin for a period of ten calendar days prior to the filling of the job vacancy. Employees within all departments, desiring consideration in filling the job vacancy, shall signify their desire by submitting a job bid application during the period in which it is posted. A receipt of the job application shall be given to the employee. All jobs will be awarded from within the job vacancy department within seven (7) calendar days from on the end bulletins board in order to allow bargaining unit employees to apply. Selection of the ten successful candidate will be by bargaining unit seniority provided the employee has the skills and qualifications or can be trained within a reasonable period of time to fulfill all the requirements of the job.
