Common use of Internet Services Clause in Contracts

Internet Services. In accordance with the requirements of Executive Order No. 175, Contractor certifies that it will adhere to net neutrality principles if this contract is for the provision of internet services, regardless of delivery method, to all end users in New York State, unless the President/CEO of the Agency or Agencies, or their designee, determines that adherence to net neutrality principles for a particular purpose is not in the best interests of the State. Nothing in this provision supersedes any obligation or authorization a provider of broadband Internet access service may have to address the needs of emergency communications or law enforcement, public safety, or national security authorities, consistent with or as permitted by applicable law, or limits the provider’s ability to do so. As used herein, “net neutrality” means that Contractor will not block, throttle, or prioritize internet content or applications or require that end users pay different or higher rates to access specific types of content or application.
