Common use of Injury or Damage to Person or Property Clause in Contracts

Injury or Damage to Person or Property. If during the performance of the Trade Contractor Work any member of the Project Team suffers injury or damage to person or property because of an act or omission of any other member of the Project Team, such other party’s employees or agents, or others for whose acts such member of the Project Team is legally liable, written notice of such injury or damage, whether or not insured, shall be given to the other member of the Project Team within a reasonable time not exceeding twenty-one (21) Days after first observance of the injury or damage. The notice shall provide sufficient detail to enable the other members of the Project Team to investigate the matter.
