Information and. Access to Provide the Harbour Services Subject to each of their pre-existing confidentiality obligations, each Harbour Recipient must provide the Manager with all data, information and access to all of its information technology systems, equipment, personnel and premises to which it has access as are reasonably required to enable the Manager to perform the Harbour Services. The Manager will not be liable for any failure to provide, or delay in providing, a Harbour Service to the extent that the failure or delay is caused by a failure of a Harbour Recipient to comply with the information and access obligation detailed above, other than where such delay is caused by the actions of employees of the Manager acting under the direction or control of the Manager (unless such employees are restrained from acting pursuant to law or any third party arrangements).

  • Information and Data 21.1 At all times during the subsistence of this Agreement the duly authorized representatives of each Participant shall, at its and their sole risk and expense and at reasonable intervals and times, have access to the Property and to all technical records and other factual engineering data and information relating to the Property which is in the possession of the Operator.

  • INFORMATION AND PRIVACY You understand and agree that in conjunction with employee training, quality control and the provision of services, we may monitor and/or electronically record cellular transmissions related to the Services, as well as conversations with you or others. Further, you understand that privacy cannot be guaranteed on telephone, cellular network and computer systems, and we shall not be liable to you for any claims, loss, damages or costs which may result from a lack of privacy experienced.
