Common use of Health and Safety Plan Clause in Contracts

Health and Safety Plan. Within 30 days after the Effective Date, Purchaser shall submit for EPA review and comment, in accordance with Paragraph 36, a plan that ensures the protection of the public health and safety during performance of on-site work under this Settlement. Purchaser shall prepare the plan in accordance with “OSWER Integrated Health and Safety Program Operating Practices for OSWER Field Activities,” Pub. 9285.0-OIC (November 2002), available on the NSCEP database at xxxxx://xxx.xxx.xxx/nscep, and “EPA’s Emergency Responder Health and Safety Manual,” OSWER Directive 9285.3-12 (July 2005 and updates), available at xxxxx://xxx.xxxxxx.xxx/_HealthSafetyManual/manual-index.htm. In addition, Purchaser shall ensure that the plan complies with all currently applicable Occupational Safety and Health Administration (OSHA) regulations found at 29 C.F.R. Part 1910. If EPA determines that it is appropriate, the plan must also include contingency planning. Purchaser shall incorporate all changes to the plan recommended by EPA and shall implement the plan during the pendency of the removal action.‌‌‌‌‌‌
