The Hardware Malfunction clause defines the responsibilities and procedures in the event that hardware provided under the agreement fails to operate as intended. Typically, this clause outlines the steps the parties must take if a malfunction occurs, such as notification requirements, repair or replacement timelines, and any limitations on liability or warranty coverage. Its core practical function is to ensure that both parties understand their obligations and remedies when hardware issues arise, thereby minimizing disputes and downtime caused by equipment failures.
Hardware Malfunction. Any malfunction in the Hardware shall be reported by Customer to Miovision by email at ▇▇▇▇▇▇▇@▇▇▇▇▇▇▇▇▇.▇▇▇ or by phone at 877­646­8476 without delay, and by providing sufficient detail to Miovision such that it can provide reasonable support to Customer to resolve the problem. If the cause of the malfunction cannot be determined by e­mail or phone, Miovision shall so notify Customer and Customer shall return the Hardware to Miovision, at Customer’s cost and expense. Miovision will investigate the malfunction to determine either: (i) if the malfunction was caused by user error or insufficient operating skill of Customer or its agents, in which case Miovision shall so notify Customer and fix the Hardware and Customer shall be responsible for all costs related to the repair and return shipping of the Hardware; or (ii) if the malfunction is due to a manufacturing problem, or a problem not otherwise caused by Customer or its agents, in which case Miovision shall so notify Customer, and Miovision may, at its sole discretion: (a) fix the Hardware, or
Hardware Malfunction. 12.9.1. Online: ● In the case of any hardware malfunctions, player/team affected by hardware malfunctions shall provide demonstrable evidence and EM officials shall determine whether the hardware malfunction constitutes a minor bug (i.e. a monitor loses connectivity and a player walks directly into an enemy turret), a critical bug (i.e. a keyboard stops working, causing a player death) or a terminal situation (i.e the game server crashes) and follow the appropriate standard above.
Hardware Malfunction. If a Hardware malfunction impacts Service performance as a result of a Hardware failure, improper installation, use of Tricore Services with unauthorized hardware or software or any other reason, Tricore may terminate Services until the malfunction is corrected. Tricore will notify Subscriber in the event of any such termination of Services. It is Subscriber’s responsibility to make sure that the Hardware malfunctions are promptly addressed and do not impact the Services.

Hardware provided may not be new but may be like-new, except for Hardware purchased from NCR Voyix, which will be new. Delivery of the Hardware will be made to your designated Licensed Site(s). All Hardware purchased by you directly from NCR Voyix or from a Reseller for use in the United States, including Alaska and Hawaii, includes a standard 30-day non-transferable warranty against defects in manufacture, beginning on the date of purchase. Damage from wear and tear, misuse and other factors are not covered.

  • Equipment Failures In the event of equipment failures beyond the Administrator's control, the Administrator shall take reasonable and prompt steps to minimize service interruptions but shall have no liability with respect thereto. The Administrator shall develop and maintain a plan for recovery from equipment failures which may include contractual arrangements with appropriate parties making reasonable provision for emergency use of electronic data processing equipment to the extent appropriate equipment is available.

  • Electrical Provide drawings for the following systems: .1 Lighting including circuiting and luminaire identification and switching. Also provide illuminance computer printout for all indoor typical indoor spaces and parking lots. .2 Convenience outlets and circuiting, special outlets and circuiting, television outlets, and power systems and equipment. Provide riser diagrams for all electrical systems including master clock, intercom, fire alarm, ITV, computer networking/telephone. Also, provide for emergency and normal power distribution. Provide luminaire schedule. .3 Panel schedule may be in preliminary form but circuitry must be included. .4 Applicable installation details. .5 General legend and list of abbreviations. .6 Voltage drop computation for all main feeders. .7 Short circuit analysis .8 Provide 1/2" scale floor plan and wall elevations for all electrical rooms.

  • Sprinkler System TWENTY-SIXTH.--If there now is or shall be installed in said building a "sprinkler system" the Tenant agrees to keep the appliances thereto in the demised premises in repair and good working condition, and if the New York Board of Fire Underwriters or the New York Fire Insurance Exchange or any bureau, department of official of the State or local government requires or recommends that any changes, modifications, alterations or additional sprinkler heads or other equipment be made or supplied by reason of the Tenant's business, or the location of partitions, trade fixtures, or other contents of the demised premises, or if such changes, modifications, alterations, additional sprinkler heads or other equipment in the demised premises are necessary to prevent the imposition of a penalty or charge against the full allowance for a sprinkler system in the fire insurance rate as fixed by said Exchange, or by any Fire Insurance Company, the Tenant will at the Tenant's own expense, promptly made and supply such changes, modifications, alterations, additional sprinkler heads or other equipment. As additional rent hereunder the Tenant will pay to the Landlord, annually in advance, throughout the term $ toward the contract price for sprinkler supervisory service.

  • Hardware Warranty Company warrants that for a period of one (1) year from delivery of Hardware, Hardware will be free from defects in material and workmanship in normal use, but does not cover any of the following: (i) improper installation, maintenance, adjustment, repair or modification by Customer or a third party; (ii) misuse, neglect, or any other cause other than ordinary use, including without limitation, accidents or acts of God; (iii) improper environment, excessive or inadequate heating or air conditioning, electrical power failures, surges, water damage or other irregularities; (iv) third party software or software drivers; or (v) damage during shipment.
