Common use of Funds Available and Authorized Clause in Contracts

Funds Available and Authorized. Consultant shall not be compensated for Services performed under this Agreement by any other agency or department of the State of Oregon. Agency believes it has sufficient funds currently available and authorized for expenditure to finance the costs of this Agreement within Agency’s biennial appropriation or limitation. Consultant understands and agrees that Agency’s payment of amounts under this Agreement is contingent on Agency receiving appropriations, limitations, or other expenditure authority sufficient to allow Agency, in the exercise of its reasonable administrative discretion, to continue to make payments under this Agreement.
