Funds Availability. You understand and agree that deposits of Images via transmission to the Service may not be available for immediate withdrawal, and we may withhold the availability of funds from the deposited Image. You understand and agree that, at the expiration of this 30 calendar day period, you MUST destroy the original Check via a commercially acceptable means of destruction, including shredding (preferably via a cross-cut shredder), burning or pulverizing the original Check, after which the Image will be the only evidence of the original Check. You understand and agree that it is your responsibility to establish and maintain appropriate procedures and controls to safeguard the original Check and to prevent any further use. You agree that you will notify us IMMEDIATELY if you learn of the loss or theft of an original Check, an Image of which was transmitted via the Service for deposit to an Account. You understand and agree that, during such time as you retain the original Check, that we may require you to make the original Check available to us within 5 calendar days, at your expense. You further agree that if you fail to provide the original Check to us within 5 calendar days, we may reverse the deposit made to the Account, and that you will be responsible for any loss incurred by you, the Account owner or us as a result of such reversal. You understand and agree that once an Image of a Check has been transmitted via the Service, the original Check may never again be used for any purpose, particularly for deposit. Any violation of this provision may result in immediate termination of your access to the Service, and the recovery of any loss incurred by the Credit Union for any violation of this provision will be pursued by any collection means available to us.

Funds Availability. You understand and agree The funds for the Checks that deposits of Images via transmission to you deposit through the Service may not be immediately available to you. The funds for immediate withdrawal, and we may withhold the availability of funds from the deposited Image. We do not guarantee that any Image transmitted via the Service will be received by Check has been deposited through the Service, accepted by the Credit Union original Check is your property and not the property of the Bank. You shall securely store the original Check for a reasonable period, not to exceed sixty (60) days, after you receive a deposit receipt through the Service that the Check has been accepted. While the original Check is in your possession, you agree to use a high degree of care to safeguard the original Check and related files against security risks. Security risks include, without limitation, the theft or ultimately deposited reproduction of the original Check or unauthorized use of the information on the Check or in the file. You shall take appropriate security measures to ensure that: a) only authorized persons shall have access to the Account. You understand original Check; b) the information contained on the Check shall not be disclosed to unauthorized persons; and agree that any time-sensitive deposit (such as one to be used for a loan or other paymentc) should NOT be transmitted as an Image via the Service and should be presented in person at one of our locations. The Credit Union original Check will not be responsible for duplicated, will not be scanned more than one time, and will not be presented, deposited or negotiated again in any lossway. Upon request by the Bank you will promptly provide to the Bank a retained original Check, charge or fee you incur as a result of your use sufficient copy of the Service which results front and back of the Check in form acceptable to us, to aid in the clearing and collection process, or to resolve claims by third parties, or for our audit or fraud loss prevention purposes. After the sixty (60) day retention period expires, you shall destroy the original Check by shredding it or by any late other permanent deletion manner that does not allow the original Check to be accessed by an unauthorized person(s) and in a manner that the original Check is no longer readable or non-payment capable of any withdrawal from the Accountbeing reconstructed. Storage and Destruction of Original Checks – Upon receipt of confirmation that we have accepted an Image After destruction of an original Check, you understand and agree that you will retain possession of the original Check for a period of 30 calendar days, during which time you will ensure the safety and integrity of the original Check. You understand and agree that, at the expiration of this 30 calendar day period, you MUST destroy the original Check via a commercially acceptable means of destruction, including shredding (preferably via a cross-cut shredder), burning or pulverizing the original Check, after which the Image image will be the only sole evidence of the original Check. You understand and agree that it is your responsibility to establish and maintain appropriate procedures and controls to safeguard you will never present the original Check more than one time. You understand that you are responsible if anyone is asked to make a payment based on an original Check that has already been paid. You agree to be responsible to us for any losses, costs, expenses, and damages we may incur as a result of your failure to prevent comply with the provisions of this Section. Prohibition Against Presenting Checks More Than Once: Once you have used the Service to deposit a Check you agree not to present, or allow anyone else to present, that original Check or a substitute Check of that original Check again for deposit through the Service or by any further useother means. If you or anyone else present a Check or substitute Check for deposit more than once, in violation of this Agreement, you agree to indemnify, defend and hold the Bank harmless from and against all liability and damages that may result from any claims, suits or demands from third parties with respect to such Check or substitute Check. You agree that you will notify us IMMEDIATELY if you learn of the loss or theft of an original Check, an Image of which was transmitted via the Service for deposit to an Account. You understand and agree that, during such time as you retain the original Check, that we may require you debit from your Bank account the aggregate amount of any Checks that are deposited more than once. To the extent that funds in your account are insufficient to make the original Check available to us within 5 calendar days, at your expense. You further agree that if you fail to provide the original Check to us within 5 calendar dayscover such amount, we may reverse shall debit the deposit made to the Account, and that you will be responsible for deficiency amount from any loss incurred by you, the Account owner or us as a result of such reversal. You understand and agree that once an Image of a Check has been transmitted via the Service, the original Check may never again be used for any purpose, particularly for deposit. Funds Availability. You understand and agree that deposits of Images via transmission items transmitted to us using the Services are not subject to the Service may funds availability requirements of Regulation CC or the Funds Availability Policy in the Deposit Account Agreement. You understand and agree that once an Image of a Check has been transmitted via the Servicedestroyed, the original Check may never again be used for any purpose, particularly for deposit. Any violation checks are no longer readable or capable of this provision may result in immediate termination of your access to the Service, and the recovery of any loss incurred by the Credit Union for any violation of this provision will be pursued by any collection means available to usbeing reconstructed.
