Common use of Family and Medical Leave Act (FMLA) Entitlements Clause in Contracts

Family and Medical Leave Act (FMLA) Entitlements. (a) The Family and Medical Leave Act of 1993 (hereafter "FMLA") is the common name for the Federal law providing eligible faculty members (whether salaried or paid from Other Personal Services (OPS) funds) an entitlement of up to four hundred and eighty (480) hours of leave without pay for qualified family or medical reasons during a one (1) year period. This Act entitles the faculty member to take leave without pay; where University policies permit, faculty may use accrued leave with pay during any qualifying family or medical leave. The failure to list, define, or specify any particular provision or portion of the FMLA in this Agreement will in no way constitute a waiver of any rights or benefits conferred to the University or the faculty member through the FMLA.

(a) The Family and Medical Leave Act of 1993 (hereafter "“FMLA"”) (xxxxx://xxx.xxx.xxx/) is the common name for the Federal federal law providing eligible faculty members (whether salaried or paid from Other Personal Services (OPS) funds) employees an entitlement of up to four hundred and eighty twelve workweeks (480i.e., 480 hours) of continuous leave or up to 480 hours of intermittent leave without pay for qualified family or medical reasons during a one (1) one-year period. This Act entitles the faculty member employee to take leave without pay; where University policies permit, faculty employees may use accrued leave with pay at their discretion during any qualifying family or medical leave. Employees are entitled to use FMLA in accordance with law and University policy. The failure to list, define, or specify any particular provision or portion of the FMLA in this Agreement will shall in no way constitute a waiver of any of the rights or benefits conferred to the University employer or the faculty member employee through the FMLA.
