ESS O&M Work. Provider shall provide operation, repair, monitoring and maintenance services to the ESS System during the Storage Services Term (the “ESS O&M Work”). Provider shall maintain during the Storage Services Term the capability to provide such ESS O&M Work, either directly or indirectly, or through a third-party service provider capable of providing comparable services, provided that Provider remains responsible for all operation, repair, monitoring and maintenance services to the ESS System notwithstanding any such subcontracting. Provider shall use commercially reasonable efforts to enforce the terms of any contract for operations and maintenance services to which it is a party and ESS warranty agreements.
