Employee Covenant not to Xxx. Employee agrees that he will not bring any legal action against the Releasees for any claim that occurred prior to his signing this Agreement; however, this provision does not prohibit Employee from filing a claim or lawsuit for the purpose of enforcing his rights under (i) the Company’s 401(k) Plan or any other ERISA plan, (ii) any right of indemnification that the Employee may have, (iii), any right that Employee may have under this Agreement, or (iv) any rights that may arise subsequent to his signing this Agreement.
