Discounted Sales. It is possible that a Licensed Product could be included as part of a package of products offered to customers by Celgene or its Affiliates or Sublicensees, and that discounts on packages including a Licensed Product (a “Package”) may be offered in the Territory. None of Celgene, its Affiliates or Sublicensees shall discount the price of a Licensed Product sold as part of a Package [***].
Discounted Sales. In the event that one or more Program Products is included as part of a package of products offered to customers of Sanofi, and discounts on packages including Program Products are offered independently in the Territory, Sanofi shall not discount the price of the Program Products sold as part of a package unreasonably compared to the discount Sanofi offers on prices of the other products included in such package.
Discounted Sales. Provention shall not, and shall not permit any member of the Provention Group to, unreasonably discount the price of a Product included in a package of products offered for sale by Provention or any member of the Provention Group (a “Package”) compared to the price of the other products included in such Package.
Discounted Sales. In the event that one or more Licensed Products is included as part of a package of products offered to customers of AstraZeneca, and discounts on packages including Licensed Products are offered independently in the Territory, AstraZeneca shall not discount the price of the Licensed Products sold as part of a package unreasonably compared to the discount AstraZeneca offers on prices of the other products included in such package.
Discounted Sales. It is possible that a Licensed Product could be included as part of a package of products offered to customers by Roche or its Affiliates or Sublicensees, and that discounts on packages including a Licensed Product (a “Package”) may be offered independently in the Shared Territory and the Royalty Territory. Roche shall not discount the price of a Licensed Product sold as part of a Package unreasonably compared to the discount Roche offers on prices of the other products included in such Package.
Discounted Sales. In the event that one or more Licensed Products is included as part of a package of products offered to customers of FOSUN, and discounts on packages including Licensed Products are offered independently in the Territory, FOSUN shall not discount the price of the Licensed Products sold as part of a package unreasonably compared to the discount FOSUN offers on prices of the other products included in such package.
Discounted Sales. It is possible that a Juno Program Co-Co Product could be included as part of a package of products offered to customers by either Party or its Affiliates or Sublicensees, and that discounts on packages including a Juno Program Co-Co Product (a “Package”) may be offered in the Territory. It is possible that a Celgene Program Co-Co Product could be included as part of a package of products offered to customers by either Party or its Affiliates or Sublicensees, and that discounts on packages including a Celgene Program Co-Co Product (a “Package”) may be offered in the Territory. Neither Celgene, its Affiliates nor Sublicensees shall discount the price of a Celgene Program Co-Co Product sold as part of a Package [***].
Discounted Sales. It is possible that one or more ---------------- Collaboration Products could be included as part of a multiple product offering to customers by ORTHO in the Co-Promotion Territory or the Royalty Bearing Territory. In the event that one or more Collaboration Products is offered along with other ORTHO products, discounts from the Ex-Manufacturer Selling Price exceeding the greater of ***** or the then government mandated Medicaid discount will be a cost borne solely by ORTHO. If market dynamics change, CTI and ORTHO may agree, which agreement will not be unreasonably withheld or delayed, to discount beyond the stated ***** discount or the then government mandated Medicaid discount from the Ex-Manufacturer Selling Price, and in this situation, the effect of the discount will be borne equally by CTI and ORTHO. This Section 7.14 regarding "discounted sales" will only be in effect while the Collaboration Product is covered by a valid Patent.
