Common use of Discharge/Suspension Clause in Contracts

Discharge/Suspension. 1. Staff members who fail to satisfactorily perform their assigned duties may be discharged or suspended, but in respect to discharge shall be given at least one warning notice in writing within twelve (12) months prior to discharge. A copy of any notice of suspension or discharge shall be given to the DESPA President or DESPA Designee except that no warning notice need be given prior to discharge if the staff member is a probationary employee (probationary period is the first 90 days of employment).
