Definitions in the UCC, etc. Terms used herein that are not defined herein, in the FOSO Intercreditor Agreement or in the Second-Out Credit Agreement, but that are terms defined in the UCC, shall have the meanings specified therein (and if defined in more than one article of the UCC, shall have the meaning specified in Article 9 thereof); the term “instrument” shall have the meaning specified in Article 9 of the UCC.
