Contractable Area. Anything to the contrary stated in any other section of this Master Deed notwithstanding the developer, without consent of any Co-owners, shall for a period of six (6) years after recording of this Master Deed, have the right to convey or dedicate to the Michigan Department of Transportation such portion of the open space adjoining M-59, as designated in Exhibit "B", as is necessary in the Developer's sole determination for the expansion of M-59. The area is described as follows: Commencing at the West 1/4 corner of Section 30, T3N, R5E, Oceola Township, Xxxxxxxxxx County, Michigan; thence South 89*30'09" East 1342.57 feet along the East-West 1/4 line of said Section 30, said point being North 89*30'09" West 1333.24 feet along the East-West 1/4 line of Section 30 from the Center of said Section 30; thence North 00*03'55" West 27.64 feet to the Northerly Right-of-Way line of Highway M-59 (Highland Road) and the POINT OF BEGINNING; thence continuing North 00*03'55" West 180.03 feet; thence North 88*49'37" East 1179.56 feet; thence South 00*12'02" East 180.05 feet; thence South 88*49'37" West 1178.73 feet along the Northerly Right-of-Way of said Highway M-59 (Highland Road) to the Point of Beginning.   • Built-up Area The built-up area for the Designated Apartment or any other Unit shall mean the Carpet Area of such Unit and Balcony area and 50% (fifty percent) of the area covered by those external walls which are common between such Unit/Balcony and any other Unit/Balcony and the area covered by all other external walls of the such Unit/Balcony.

  • ESTIMATED / SPECIFIC QUANTITY CONTRACTS Estimated quantity contracts, also referred to as indefinite delivery / indefinite quantity contracts, are expressly agreed and understood to be made for only the quantities, if any, actually ordered during the Contract term. No guarantee of any quantity is implied or given. With respect to any specific quantity stated in the contract, the Commissioner reserves the right after award to order up to 20% more or less (rounded to the next highest whole number) than the specific quantities called for in the Contract. Notwithstanding the foregoing, the Commissioner may purchase greater or lesser percentages of Contract quantities should the Commissioner and Contractor so agree. Such agreement may include an equitable price adjustment.

  • MAINTENANCE OF CONCESSION PREMISES A. Concessionaire shall preserve and maintain the Concession Premises in good and clean condition, reasonable wear and tear excepted. Concessionaire is solely responsible for the maintenance and cleanliness of the Concession Premises.

  • Service Areas The MCP agrees to provide services to Aged, Blind or Disabled (ABD) members, Modified Adjusted Gross Income (MAGI) members, and Adult Extension members residing in the following service area(s): Central/Southeast Region ☐ Northeast Region ☐ West Region ☐ The ABD and MAGI categories of assistance are described in OAC rule 5160-26-02. The Adult Extension category is defined in Ohio’s Medicaid State Plan as authorized by the Centers for Medicare and Medicaid Services (CMS). The MCP shall serve all counties in any region they agree to serve.

  • Work Area The specific work area and/or crew an employee reports to on a daily schedule. Work areas are generally smaller divisions of a larger Bid Area.

  • Use of Basement and Service Areas The basement(s) and service areas, if any, as located within the (project name), shall be earmarked for purposes such as parking spaces and services including but not limited to electric sub-station, transformer, DG set rooms, underground water tanks, pump rooms, maintenance and service rooms, fire fighting pumps and equipment's etc. and other permitted uses as per sanctioned plans. The Allottee shall not be permitted to use the services areas and the basements in any manner whatsoever, other than those earmarked as parking spaces, and the same shall be reserved for use by the association of allottees formed by the Allottees for rendering maintenance services.

  • PREVAILING WAGE RATES - PUBLIC WORKS AND BUILDING SERVICES CONTRACTS If any portion of work being Bid is subject to the prevailing wage rate provisions of the Labor Law, the following shall apply:

  • Horizontal Movement The Board encourages all unit members to improve their skills through advanced training and, as an inducement thereto, provides extra compensation for those who do so successfully. The Board delegates to the Superintendent the responsibility for assuring that unit members comply with the following regulations when claiming credit for advanced studies.

  • MAINTENANCE OF THE BUILDING /APARTMENT / PROJECT The Promoter shall be responsible to provide and maintain essential services in the Project till the taking over of the maintenance of the project by the Association upon the issuance of the completion certificate of the Project. The cost of such maintenance has been included in the Total Extras and Deposits as mentioned in clause 1.2.

  • School Improvement Plans The School shall develop and implement a School Improvement Plan as required by section 1002.33(9)(n), Florida Statutes and applicable State Board of Education Rules or applicable federal law.
