Conflicting Test Results. If any one of these samples tests negative or the remaining portion of the initial sample upon re-testing is negative, the test will be considered as having tested negative for the presence of drugs. All urine samples provided in accordance with the provisions of this Policy must test positive for the individual to be considered as under the influence of or impaired by drugs.

Conflicting Test Results. In the event of a conflict between the test results of KPI, and the test results of CIBA with respect to any shipment of Product by KPI an effort will be made to reconcile the test results. If the parties fail to reconcile such results with ten (10) days after KPI sends it notice of objection pursuant to Section 10.2, an adequate sample of the rejected Product in its bulk material form shall be submitted by KPI to an independent laboratory acceptable to both parties for testing against the specifications for Conforming Products using the procedures described in these specifications. The test results obtained by such laboratory shall be final and controlling, and the fees and expenses of the laboratory shall be borne entirely by the party against whom such laboratory findings are made. If the laboratory's findings are in flavor of KPI, CIBA shall immediately pay KPI the price invoiced for the rejected Product.

  • Conflicting Demands If conflicting or adverse claims or demands are made or notices served upon the Escrow Agent with respect to the escrow provided for herein, the Company and the Purchasers agree that the Escrow Agent shall refuse to comply with any such claim or demand and withhold and stop all further performance of this escrow so long as such disagreement shall continue.   • Conflicting Advice In the event of a conflict between directions, advice or instructions ALPS receives from the Fund or any service provider and the advice ALPS receives from counsel, ALPS may in its sole discretion rely upon and follow the advice of counsel. ALPS will provide the Fund with prior written notice of its intent to follow advice of counsel that is materially inconsistent with directions, advice or instructions from the Fund. Upon request, ALPS will provide the Fund with a copy of such advice of counsel.

  • Conflicting Agreements The Executive hereby represents and warrants that the execution of this Agreement and the performance of his obligations hereunder will not breach or be in conflict with any other agreement to which the Executive is a party or is bound and that the Executive is not now subject to any covenants against competition or similar covenants or any court order or other legal obligation that would affect the performance of his obligations hereunder. The Executive will not disclose to or use on behalf of the Company any proprietary information of a third party without such party’s consent.

  • Conflicting Orders or Instructions If the Financial Institution receives conflicting orders or instructions from the Secured Party and the Grantor or any other Person, the Financial Institution will follow the orders or instructions of the Secured Party and not the Grantor or such other Person.
