Concessionaire’s Failure to Maintain the Concession Premises. If the Concessionaire refuses, fails, or neglects to undertake the maintenance, repairs or replacements required hereunder, or if the SFRAA is required to undertake any maintenance or make any repairs or replacements necessitated by the negligent acts or omissions of the Concessionaire, its employees, agents, servants, or licensees, the SFRAA shall have the right after fifteen (15) days prior written notice, to conduct such activity or activities on behalf of or for the Concessionaire, provided, however, no notice shall be required in the case of emergencies. Such work shall be paid for by the Concessionaire within ten (10) days following demand by the SFRAA for said payment at the SFRAA’s cost or standard rates plus a twenty-five percent (25%) overhead fee.

  • MAINTENANCE OF CONCESSION PREMISES A. Concessionaire shall preserve and maintain the Concession Premises in good and clean condition, reasonable wear and tear excepted. Concessionaire is solely responsible for the maintenance and cleanliness of the Concession Premises.

  • Extension of Concession Period Subject to the provisions of Clause 35.6, in the event that a material default or breach of this Agreement set forth in Clause 35.2 causes delay in achieving COD or leads to suspension of or reduction in collection of Fee, as the case may be, the Authority shall, in addition to payment of compensation under Clause 35.2, extend the Concession Period, such extension being equal in duration to the period by which COD was delayed or the collection of Fee remained suspended on account thereof, as the case may be.

  • MAINTENANCE OF THE BUILDING /APARTMENT / PROJECT The Promoter shall be responsible to provide and maintain essential services in the Project till the taking over of the maintenance of the project by the Association upon the issuance of the completion certificate of the Project. Suspension hereunder shall be effective forthwith upon issue of notice by the Authority to the Concessionaire and may extend up to a period not exceeding 180 (one hundred and eighty) days from the date of issue of such notice; provided that upon written request from the Concessionaire and the Lenders’ Representative, the Authority shall extend the aforesaid period of 180 (one hundred and eighty) days by a further period not exceeding 90 (ninety) days.
