Comparable Positions. A position with the same or similar duties and pay which can be performed at the same or similar geographic location as the position held prior to the leave. Ordinarily, the job assignment will be the same duties in the same program area located in the same city, although specific clients, caseload, co-workers, supervisor(s), or other staffing may have changed during an employee's leave.

Comparable Positions. For the purposes of layoff and recall, a comparable position is one which has the same annual full time equivalent (FTE), appointment percentage, job classification, salary range, and geographic location as the position held by the employee subject to a layoff. A less than comparable position, in total, has; a lower percentage of annual FTE, lower appointment percentage, lower paid job classification, lower salary range, and/or different geographic location.

Comparable Positions. For one (1) year following the Employment Effective Date, Provider will provide or cause to be provided to the New Provider Employees base salary and wages, variable compensation (except with regard to variable compensation for fixed term hires), equity compensation, vacation, paid time off and employee benefits on terms and conditions substantially similar in the aggregate to those in effect for the New Provider Employees as of the Effective Date, and as set forth in Article 6 below. Provider will retain New Provider Employees for providing Services to Customer for at least one (1) year after the applicable Employment Effective Date. Provider will make every commercially reasonable effort to ensure that all Affected Employees are incentivized to remain employees through the Transition period. The foregoing requirement does not apply to a New Provider Employee who (A) voluntarily resigns from Provider, (B) is dismissed by Provider for misconduct (e.g., fraud, drug abuse, theft) or failure to perform duties and responsibilities, or (C) dies or is unable to work because of a disability. Any and all Affected Employees who decline the initial offer of employment from Provider will not be entitled to non-statutory or non-contractual severance payments from Provider, Customer or any Provider or Customer severance plan or arrangement. Comparable Positions. TCS’ offer shall be for a position that is comparable to the type of position held by the applicable Non-ARD In-Scope Employee prior to the date of the SOW (except that unless otherwise provided in the relevant SOW if in the twelve (12) months prior to the date of the SOW if Xxxxxxx has made any changes in the individual’s terms and conditions of employment outside of the ordinary course TCS need only meet the terms and conditions prior to the non-ordinary course change). Unless otherwise consented to by the Non-ARD In-Scope Employee TCS shall keep the Non-ARD In-Scope Employee in such comparable position for a period of at least twelve (12) months from the Employment Effective Date. For purposes hereof, a “comparable position” shall mean a position (a) commensurate with the Non-ARD In-Scope Employee’s education, skill and relevant experience; (b) (unless otherwise provided in the SOW) with a work location of less than thirty five (35) miles from the Non-ARD In-Scope Employee’s then current work location; and (c) providing a level of compensation and benefits which, when taken as a whole, are at least as favorable as those enjoyed by the Non-ARD In-Scope Employee immediately prior to the date of the SOW (with base salary no lower than previously provided). If the SOW provides that the offer may be contingent on relocation and at the time of the offer TCS contemplates that the applicable Non-ARD In-Scope Employee is likely to be required to relocate within twelve (12) months after the Employment Effective Date to a location which is more than thirty five (35) miles from the Non-ARD In-Scope Employee’s then current work location, TCS shall clearly inform such Non-ARD In-Scope Employee of the possibility of relocation as part of the offer process so that the Non-ARD In-Scope Employee is able to make an informed decision about whether to accept TCS’ offer of employment.

  • New Positions A. Each newly created position shall be assigned by the Employer to the national craft unit most appropriate for such position within thirty (30) days after its creation. Before such assignment of each new position the Employer shall consult with the Union for the purpose of assigning the new position to the national craft unit most appropriate for such position. The following criteria shall be used in making this determination:

  • Other Positions Executive shall immediately resign, and shall be deemed to have immediately resigned without the requirement of any additional action, from any and all position Executive holds with the Company and its Affiliates on Executive’s Date of Termination.

  • New Position An approved position not reflected in the current year budget complement.

  • Term Position A position occupied by a full-time or part-time nurse for a specified period of time, up to a maximum of sixty (60) weeks, where patient/client/resident census or workload necessitates a temporary increase in staffing, if mutually agreed, to replace a nurse(s) who is/are on vacation or leave of absence, or to carry out a special short term project or where the Employer has provided notice of permanent deletion of position(s) under the Memorandum of Understanding regarding Employment Security, or as otherwise mutually agreed between the Union and the Employer. If the Employer determines there is a term position to be filled by a nurse, the term position shall be posted in accordance with Article 30. This shall not preclude the Employer from utilizing part-time nurses and/or casual nurses to work available shifts as specified in Articles 34 and 35 when the Employer decides that a term position is not required. The Employer shall provide written confirmation of the start and expiry dates of the term position prior to the nurse's commencement in the position. This period may be extended if the Employer so requests and the Union agrees. The maximum duration specified in paragraph 1 above for term positions shall not apply in situations where a nurse is absent indefinitely due to Workers Compensation and/or illness and/or accident or where there is a temporary vacancy due to leave for Public Office.   • Vacant Positions An employee on the reinstatement roster may bid on a vacant position in a different classification in the same manner as any other regular employee pursuant to this agreement.

  • Permanent Positions All part-time and full-time positions shall be permanent unless identified as being fixed term in accordance with clause 2.2.5.

  • Position During the Term, Employer shall employ Executive, and Executive shall serve, as Chief Executive Officer, reporting to the Board of Directors of Employer (the “Board”). Executive shall have the duties, responsibilities and authority as are typical for such position at companies of comparable size to Employer and within Employer’s industry, including general executive authority over Employer’s affairs arising in the ordinary course of business, and shall perform the other services and duties as determined from time to time by the Board.

  • Filling Vacant Positions During the time the procedures outlined herein are in effect, position vacancies to be filled shall first be offered to regular employees who have a contractual right to be recalled to a position in the involved job classification or who may have a right to “bump” or transfer to the position, as the case may be. In such circumstances, the seniority provisions of the Agreement shall be observed. If no regular employee has a contractual right to the position, the following shall be given consideration in the order (priority) indicated below: 1st Priority: Qualified Job Bank employees 2nd Priority: Employees on a recall list 3rd Priority: Employee applicants from a list of eligibles 4th Priority: Displaced certified temporary employees 5th Priority: Non-employee applicants from a list of eligibles The qualifications of an employee in the Job Bank or on a recall list shall be reviewed to determine whether he/she meets the qualifications for a vacant position. Whether the employee can be trained for a position within a reasonable time (not to exceed three months) shall be considered when determining the qualifications of an employee. If it is determined that the employee does not meet the qualifications for a vacant position, the employee may appeal to the Director of Human Resources. If it is determined that an employee in the Job Bank is qualified for a vacant position, the employee shall be selected. The appointing authority may appeal the issue of whether the employee is qualified. The dispute shall be presented to and resolved by the Job Bank Steering Committee. If it is determined that an employee on a recall list is qualified for a vacant position, the employee will be given priority consideration and may be selected. Appeals regarding employees on a recall list and their qualifications for a position will be handled by the Civil Service Commission. The grievance procedure under the Labor Agreement shall not apply to determinations as to qualifications of the employee for a vacant position.

  • Open Positions In order to ensure that all interested employees are advised of employment opportunities, notice of job vacancies for regular full or part time positions will be sent to the Union, and job announcements will be posted on designated bulletin boards in the office. In addition, information about all job vacancies will be available to employees by calling the office and in pay envelopes. All regular full or part time vacancies will be posted and filled in accordance with this Agreement. Postings will include position requirements, minimum qualifications, substitute and preferred qualifications (if any) and base rate of pay.
