CHEMICAL DEPENDENCY PROGRAMS Sample Clauses

The CHEMICAL DEPENDENCY PROGRAMS clause establishes requirements or provisions related to the treatment and management of chemical dependency, such as substance abuse or addiction, within the context of the agreement. Typically, this clause outlines the availability, eligibility, and scope of programs or benefits provided to individuals who require assistance with chemical dependency, which may include counseling, rehabilitation, or coverage for treatment services. Its core practical function is to ensure that affected individuals have access to necessary support and resources, thereby addressing health and safety concerns and promoting recovery.
CHEMICAL DEPENDENCY PROGRAMS. A. An employee testing positive for drugs or alcohol under the provision of the policy shall have the option of entering into a chemical dependency program in lieu of discipline. If the employee successfully completes such a program and is not disciplined for substance abuse for eighteen (18) months following the initial charge, the discipline shall be revoked and the employee's record cleared of the offense, and it shall not be used as a basis for any other disciplinary action in the future. B. After evaluation, the program utilized by the employee must be sufficient to meet the rehabilitation needs of the employee. C. Employees temporarily unfit to perform the duties of their position because of drug or alcohol abuse may use sick leave, vacation leave, compensatory time, and light duty assignment, if available, and leave without pay during absences required as part of the rehabilitation process.
