Cancellation of Service; Return of Equipment. Cancellation notice may be made by Subscriber by telephone or by e-mail. All equipment must be returned within five (5) business days of service termination. Subscriber's then final monthly billing will not include the days from the date of cancellation notice (to MSFN) to the close of the billing period. MSFN may pay the prorated amount using the card or bank account information on file. MSFN, in its sole discretion, may issue a paper check for refund amounts paid via other means or if more economical to do so. In the event Subscriber cancels service prior to fully amortizing any installation fee extended payment obligation, the unpaid balance shall be charged Subscriber in full using the credit card or bank account on file -- all as part of the final billing.

  • Cancellation of Service You have the right to cancel this Agreement with NEC Co-op Energy without penalty or fee of any kind within three (3) federal business days after you receive your Terms of Service Agreement. NEC Co-op Energy will provide you with 45 calendar days advance written notice of any material change in the Terms of Service, either in your bill or in a separate mailing. The changes will become effective on the date stated in the notice unless you cancel your Agreement. You may cancel your Agreement no later than 10 calendar days before the effective date of the material change. In the event of cancellation, if you request a specific date to switch your service other than your next meter read date, you may incur a cost for this switch. Service Protections: NEC Co-op Energy will not terminate a customer's service for (1) delinquency of payment by a previous occupant, (2) failure to pay charges not related to electric service, (3) failure to pay for a different class of electric service, (4) failure to pay an under billing, other than for theft of service, more than 6 months old, (5) failure to pay for a disputed charge until a determination as to the accuracy is made,

  • Disconnection of Service Customer may discontinue service upon written notification to WALNUT HILL, after which Customer will still be subject to payment of all applicable charges. No initial charges shall be refunded once WALNUT HILL has accepted this contract. WALNUT HILL has the right to discontinue Customer’s service without notice if payment is more than approximately 30 days in arrears, if Customer fails to honor the terms of this agreement, if Customer violates the rules or regulations of the Federal Communications Commission (FCC), or if Customer uses the designated service for unlawful or prohibited purposes. SERVICE LEVEL AGREEMENT Based upon network availability, WALNUT HILL’s High-Speed Internet Service is a “best efforts” service that can provide Downstream speeds ranging from 2 Mbps to 100 Mbps, based upon the package selected by Customer. The actual speeds experienced by customers may vary and depend on several factors, including, but not limited to, customer location, destination on the Internet, traffic on the Internet, interference with a high frequency spectrum on the customer’s telephone line, and other devices that may be attached to the same cable pair. No minimum level of speed is guaranteed.

  • Termination of Service Termination of Service shall mean the Executive’s voluntary resignation of service by the Executive or the Bank’s discharge of the Executive without cause, prior to the Normal Retirement Age (Subparagraph I [J]).

  • Interruption of Service If required by Good Utility Practice or Applicable Reliability Standards to do so, the NYISO or Connecting Transmission Owner may require Developer to interrupt or reduce production of electricity if such production of electricity could adversely affect the ability of NYISO and Connecting Transmission Owner to perform such activities as are necessary to safely and reliably operate and maintain the New York State Transmission System. The following provisions shall apply to any interruption or reduction permitted under this Article 9.6.2:

  • Return of Equipment (a) At the expiration or termination of this Agreement or any Schedule, Lessee shall perform any testing and repairs required to place the units of Equipment in the same condition and appearance as when received by Lessee (reasonable wear and tear excepted) and in good working order for the original intended purpose of the Equipment. If required the units of Equipment shall be deinstalled, disassembled and crated by an authorized manufacturer's representative or such other service person as is reasonably satisfactory to Lessor. Lessee shall remove installed markings that are not necessary for the operation, maintenance or repair of the Equipment. All Equipment will be cleaned, cosmetically acceptable, and in such condition as to be immediately installed into use in a similar environment for which the Equipment was originally intended to be used. All waste material and fluid must be removed from the Equipment and disposed of in accordance with then current waste disposal laws. Lessee shall return the units of Equipment to a location within the continental United States as Lessor shall direct. Lessee shall obtain and pay for a policy of transit insurance for the redelivery period in an amount equal to the replacement value of the Equipment. The transit insurance must name Lessor as the loss payee. The Lessee shall pay for all costs to comply with this section (a).

  • Calculation of Service 25.7 For purposes of calculating continuous service and active service, a year shall be deemed to consist of two hundred and sixty-one (261) working days.
