Common use of Broken Service Clause in Contracts

Broken Service. Where an employee breaks his/her continuity of service by an absence from work for any reason other than a reason set out in subclause (6), the amount of leave to which he/she would have been entitled under subclause (1) shall be reduced by one forty-eighth for each week or part thereof during which any such absence occurs and the amount of payment in lieu of leave to which he/she would have been entitled under subclause (3) shall be reduced by one-twelfth of one week's pay for each week or part thereof during which any such absence occurs. Provided, however, that no reduction shall be made in respect of any absence unless the employer informs the employee in writing of his/her intentions so to do within 14 days of the termination of the absence.

Where an employee breaks his/her his continuity of service by an absence from work for any reason other than a reason set out in subclause (6)sub-clause 7.1.6 hereof, the amount of leave to which he/she he would have been entitled under subclause (1) sub-clause 7.1.1 hereof shall be reduced by one forty-eighth 1/48 for each week or part thereof during which any such absence occurs and the amount of payment in lieu of leave to which he/she he would have been entitled under subclause (3) sub- clause 7.1.4 hereof shall be reduced by one-twelfth 1/12 of one a week's ’s pay for each week or part thereof during which any such absence occurs. Provided, however, that no reduction shall be made in respect of any absence unless the employer Company informs the employee in writing of his/her intentions his intention so to do within 14 fourteen days of the termination of the absence.
