Common use of Broken Service Clause in Contracts

Broken Service. 26.7.1 Where an employee breaks his/her continuity of service (as defined), the amount of leave to which the employee would have been entitled under 26.1 will be reduced by 1/48 for each week or part thereof during which any such absence occurs and the amount of payment in lieu of leave to which the employee would have been entitled under clause 26.5 will be reduced by 1/12 of a week’s pay for each week or part thereof during which any such absence occurs.

Broken Service. 26.7.1 32.5.1 Where an employee breaks his/her continuity of service (as defined), by an absence from work for any reason other than a reason set out in 32.6 the amount of leave to which the employee he/she would have been entitled under 26.1 will 32.1 shall be reduced by 1/48 one forty eighth for each week or part thereof during which any such absence occurs and the amount of payment in lieu of leave to which the employee he/she would have been entitled under clause 26.5 will 32.4 shall be reduced by 1/12 one twelfth of a week’s pay for each week or part thereof during which any such absence occurs.

Broken Service. 26.7.1 32.5.1 Where an employee breaks his/her continuity of service by an absence from work for any reason (as defined), other than a reason set out in 4.15 of this award) the amount of leave to which the employee would have been entitled under 26.1 will 32.1 hereof shall be reduced by 1/48 one-forty- eighth for each week or part thereof during which any such absence occurs occurs, and the amount of payment in lieu of leave to which the employee would have been entitled under clause 26.5 will 32.4 hereof shall be reduced by 1/12 one-twelfth of a week’s pay for each week or part thereof during which any such absence occurs.

Broken Service. 26.7.1 Where an employee breaks his/her continuity of service (as defined)by an absence from work without the permission of the employer, the amount of leave to which the employee he/she would have been entitled under 26.1 will 14.1 and 14.3, shall be reduced by 1/48 one-forty eighth for each week or part thereof during which any such absence occurs and the amount of payment in lieu of leave to which the employee would have been entitled under clause 26.5 will be reduced by 1/12 one-twelfth of a week’s pay for each week or part thereof during which any such absence occurs.

Broken Service. 26.7.1 22.5.1 Where an employee breaks his/her continuity of service (as defined)by an absence from work for any reason other than a reason set out in 22.6 hereof, the amount of leave to which the employee he/she would have been entitled under 26.1 will 22.1 hereof shall be reduced by 1/48 1/48th for each week or part thereof during which any such absence occurs and the amount of payment in lieu of leave to which the employee he/she would have been entitled under clause 26.5 will 22.4 hereof shall be reduced by 1/12 1/12th of a week’s 's pay for each week or part thereof during which any such absence occurs.

Broken Service. 26.7.1 Where an employee Employee breaks his/her his continuity of service (as defined)by an absence from work for any reason other than a reason set out in sub-clause 7.1.5 hereof, the amount of leave to which the employee he would have been entitled under 26.1 will sub-clause 7.1.1 hereof shall be reduced by 1/48 for each week or part thereof during which any such absence occurs and the amount of payment in lieu of leave to which the employee he would have been entitled under sub- clause 26.5 will 7.1.3 hereof shall be reduced by 1/12 of a week’s pay for each week or part thereof during which any such absence occurs.

Where an employee breaks his/her continuity of service (as defined)by an absence from work for any reason other than a reason set out in 18.4.1.1, 18.4.1.2 and 18.4.1.3, the amount of leave to which the employee he/she would have been entitled under 26.1 will 18.1, shall be reduced by 1/48 1/48th for each week or part thereof during which any such absence occurs and the amount of payment in lieu of leave to which the employee he/she would have been entitled under clause 26.5 will 18.12, shall be reduced by 1/12 one-twelfth of a week’s 's pay for each week or part thereof during which any such absence occurs.
