The "Backing test in motion" clause establishes the requirements and procedures for verifying that a particular process, system, or product is functioning correctly while it is actively operating. In practice, this clause may require real-time monitoring, data collection, or performance assessments to ensure that the subject under test meets specified standards during its normal use or operation.   • Drug Testing (A) The state and the PBA agree to drug testing of employees in accordance with section 112.0455, F.S., the Drug-Free Workplace Act. (B) All classes covered by this Agreement are designated special risk classes for drug testing purposes. Special risk means employees who are required as a condition of employment to be certified under Chapter 633 or Chapter 943, F.S. (C) An employee shall have the right to grieve any disciplinary action taken under section 112.0455, the Drug-Free Workplace Act, subject to the limitations on the grievability of disciplinary actions in Article 10. If an employee is not disciplined but is denied a demotion, reassignment, or promotion as a result of a positive confirmed drug test, the employee shall have the right to grieve such action in accordance with Article 6.

  • Hearing Tests Audiometric tests should be conducted within two months of a person commencing employment, and thereafter at intervals of two years.

  • Random Testing Notwithstanding any provisions of the Collective Agreement or any special agreements appended thereto, section 4.6 of the Canadian Model will not be applied by agreement. If applied to a worker dispatched by the Union, it will be applied or deemed to be applied unilaterally by the Employer. The Union retains the right to grieve the legality of any imposition of random testing in accordance with the Grievance Procedure set out in this Collective Agreement.

  • Synchronization The Licensor hereby grants limited synchronization rights for One (1) music video streamed online (Youtube, Vimeo, etc..) for up to 500,000 non-monetized video streams on all total sites. A separate synchronisation license will need to be purchased for distribution of video to Television, Film or Video game.

  • Problem Solving Employees and supervisors are encouraged to attempt to resolve on an informal basis, at the earliest opportunity, a problem that could lead to a grievance. If the matter is not resolved by informal discussion, or a problem-solving meeting does not occur, it may be settled in accordance with the grievance procedure. Unless mutually agreed between the Employer and the Union problem-solving discussions shall not extend the deadlines for filing a grievance. The Union ▇▇▇▇▇▇▇ or in their absence, the Local Union President, or Area ▇▇▇▇▇▇▇, or Chief ▇▇▇▇▇▇▇, either with the employee or alone, shall present to the appropriate supervisor a written request for a meeting. If the supervisor agrees to a problem- solving meeting, this meeting shall be held within fourteen (14) calendar days of receipt of the request. The supervisor, employee, Union ▇▇▇▇▇▇▇, and up to one (1) other management person shall attempt to resolve the problem through direct and forthright communication. If another member of management is present that person will not be hearing the grievance at Step Two, should it progress to that Step. The employee, the Union ▇▇▇▇▇▇▇ or in their absence, the Local Union President, or Area ▇▇▇▇▇▇▇, or Chief ▇▇▇▇▇▇▇, may participate in problem-solving activities on paid time, in accordance with Article 31, Union Rights, Section 1H.
