Allocation of insurance indemnity. CLAUSE 25. If any covered damage occurs and the Lessor does not terminate in accordance with the provisions agreed upon in the contract, then without prejudice to the provision of clause 20 above, the insurance indemnity actually collected from the Insurance Company shall be used to pay the damage that occurs, or in case of a total loss, then for the replacement of the Leased Asset. However, during the recovery of the damage, or replacement of the Leased Asset in case of a total loss, any expenses, costs and payments of any type, nature, category and reason, which are incurred due to uncovered risks and/or which exceed the insurance indemnity shall be borne by the Lessee. The period of time spent for the recovery of the damage or replacement of the Leased Asset in case of total loss shall not be added to the term which is specified herein as the lease term, and the Lessee shall continue to meet all its liabilities and commitments arising from the Contract uninterruptedly within that period. In case a dispute with the Insurance Company occurs, any expenses of the Lessor for the assignment of a referee, expert, appraiser, or specialist, and other expenses, and where an action has been instituted against the Insurance Company, court expenses and legal proceeding expenses as well as fees payable by the Lessor to its attorneys shall be borne by the Lessee.
