Agreement and acknowledgements. In consideration for the Territory agreeing to the Bioprospector engaging in Bioprospecting in respect of the Permitted Biological Resources, the Bioprospector agrees to share the Benefits arising from the Bioprospecting or Research, including the Permitted Biological Resource Intellectual Property on the terms of this Agreement. The Territory acknowledges that by signing this Agreement it hereby provides its consent to the terms of the Agreement as required by section 27(3) of the Act and to the Bioprospector engaging in Bioprospecting in respect of the Permitted Biological Resources on the terms of this Agreement. The parties acknowledge and agree that notwithstanding the provisions of the Act, they are bound by the terms and conditions of this Agreement, and that pursuant to the section 41 of the Act it is an offence for the Bioprospector to breach a condition of this Agreement.
